Subsection 112.2 of the IFC, entitled “Owner/occupant responsibility,” is hereby and the following <br />inserted in its place. <br /> <br />112.2 Owner responsibility. Correction and abatement of violations of this code shall be the <br />responsibility of the owner of the property where the violation occurred. <br /> <br />H. Subsection 112.4 of the IFC, entitled “Violation penalties,” is hereby and the following inserted in its <br />place. <br /> <br />112.4 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply <br />with any or the requirements thereof or who shall erect, install, alter, repair or do work in violation <br />of the approved construction documents or directive of the fire code official, or of a permit or <br />certificate use under provisions of this code, may be prosecuted as a civil infraction under EMC <br />Chapter 1.20. <br /> <br />I. Subsection 113.4 of the IFC, entitled “Failure to comply,” is hereby deleted and the following <br />inserted in its place: <br /> <br /> 113.4 Failure to comply. Any person who shall continue any work after having been served with a <br />stop work order, except such work as that person is directed to perform to remove a violation or <br />unsafe condition, shall be liable to a fine pursuant to EMC Chapter 1.20. <br /> <br />16.03.020 Amendments to IFC Chapter 2, Definitions. <br /> <br />Adopted as amended by Washington State. <br /> <br />16.03.030 Amendments to IFC Chapter 3, General Requirements. <br /> <br />Adopted as amended by Washington State with the following local amendments: <br /> <br />A. Section 307 of the IFC, entitled “OPEN BURNING, RECREATIONAL FIRES AND PORTABLE OUTDOOR <br />FIREPLACES,” is hereby deleted and the following inserted in its place: <br /> <br />SECETION 307 OUTDOOR BURNING <br /> <br />307.1 General. It shall be unlawful and a public nuisance for any person to kindle or maintain or <br />authorize to be kindled or maintained any outdoor burning within the City of Everett. <br /> <br />Exceptions: <br />1. Residential and commercial outdoor cooking using barbecue grills, barbecue pits, <br />barbecue smokers, and other similar food cooking devices operated in its intended <br />purpose as per manufacturer’s recommendations and complying with Section 308.1.4 <br />and any other provisions found within the Everett Fire Code.
