While the garage was vacated it was never made compliant through the permit process.The structure
<br /> was again found to be occupied for residential purposes in year 2020 and a Hearing Examiner Order was
<br /> issued for case CE20-0008 which required the structure be vacated and the owner return the structure
<br /> to a compliant state through the permit process.The owner has failed to comply,and the garage
<br /> structure remains Unlawful.
<br /> The inspection on February 7,2024,further revealed electrical power is still active in the detached
<br /> accessory structure despite no known and approved connection. Uncovered inoperable vehicles were
<br /> present and nuisances including vehicle parts, litter,a discarded television,junk and household items
<br /> behind the garage that are visible from other properties,and a very large pile of discarded wood and
<br /> junk in the back yard—also visible to other properties.
<br /> The garage structure has never been approved for residential use, and the lack of approved electrical
<br /> service,and unpermitted alterations to the detached garage/shop,further render the structure unfit for
<br /> any human occupancy as defined by the international Property Maintenance Code(IPMC)Sections
<br /> 108.1.3, in violation of IPMC 106.1, which read:
<br /> • IPMC 108.1.3 Structure unfit for human occupancy
<br /> A structure is unfit for human occupancy whenever the code official finds that such structure is
<br /> unsafe, unlawful or, because of the degree to which the structure is in disrepair or lacks
<br /> maintenance, is insanitary,vermin or rat infested,contains filth and contamination,or lacks
<br /> ventilation,illumination,sanitary or heating facilities or other essential equipment required by
<br /> this code,or because the location of the structure constitutes a hazard to the occupants of the
<br /> structure or to the public.
<br /> IPMC 106.1 Unlawful acts.
<br /> It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any
<br /> of the provisions of this code.
<br /> The unpermitted alterations to the garage structure,including electrical and plumbing systems,and the
<br /> conversion to occupied space,are violations of the International Residential Code(IRC)105.1, Permits
<br /> required,and render the garage structure Unlawful as defined by IPMC 108.1.4,in violation of IPMC
<br /> 106.1,which read:
<br /> • IRC 105.1 Required.
<br /> Any owner or authorized agent who intends to construct, enlarge, alter,repair,move, demolish
<br /> or change the occupancy of a building or structure, or to erect,install,enlarge, alter, repair,
<br /> remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of
<br /> which is regulated by this code,or to cause any such work to be done,shall first make
<br /> application to the building official and obtain the required permit.
<br /> IPMC 108.1.4 Unlawful structure.
<br /> An unlawful structure is one found in whole or in part to be occupied by more persons than
<br /> permitted under this code,or was erected, altered or occupied contrary to law.
<br /> IPMC 106.1 Unlawful acts.
<br /> It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any
<br /> of the provisions of this code.
