2024 Pavement Maintenance Overlay SPECIAL PROVISIONS PW# 3823 24 (January 4, 2016 APWA GSP) 1 2 The Contractor shall provide Excess or Umbrella Liability insurance with limits of not less than 3 *** Two *** million each occurrence and annual aggregate. This excess or umbrella liability 4 coverage shall be excess over and as least as broad in coverage as the Contractor’s 5 Commercial General and Auto Liability insurance 6 7 All entities listed under 1-07.18(2) of these Special Provisions shall be named as additional 8 insureds on the Contractor’s Excess or Umbrella Liability insurance policy. 9 10 This requirement may be satisfied instead through the Contractor’s primary Commercial 11 General and Automobile Liability coverages, or any combination thereof that achieves the 12 overall required limits of insurance. 13 14 1-07.18(5)E.RTF 15 1-07.18(5)E LHWCA Insurance 16 (January 4, 2016 APWA GSP) 17 18 If this Contract involves work on or adjacent to Navigable Waters of the United States, the 19 Contractor shall procure and maintain insurance coverage in compliance with the statutory 20 requirements of the U.S. Longshore and Harbor Workers' Compensation Act (LHWCA). 21 22 Such policy must provide the following minimum limits: 23 $1,000,000 Bodily Injury by Accident – each accident 24 $1,000,000 Bodily Injury by Disease – each employee 25 $1,000,000 Bodily Injury by Disease – policy limits 26 27 COE 1-07.18(5)J.RTF 28 1-07.18(5)J Pollution Liability 29 (January 4, 2016 APWA GSP) 30 31 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for 32 claims involving bodily injury, property damage (including loss of use of tangible property 33 that has not been physically injured), cleanup costs, remediation, disposal or other handling 34 of pollutants, including costs and expenses incurred in the investigation, defense, or 35 settlement of claims, arising out of any one or more of the following: 36 1. Contractor’s operations related to this project. 37 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or 38 materials containing asbestos. 39 3. Transportation of hazardous materials away from any site related to this project. 40 41 All entities listed under 1-07.18(2) of these Special Provisions shall be named by 42 endorsement as additional insureds on the Contractors Pollution Liability insurance policy. 43 44 Such Pollution Liability policy shall provide the following minimum limits: 45 *** $2,000,000 *** each loss and annual aggregate 46 47 1-07.18(5)K.RTF 48 1-07.18(5)K Professional Liability 49 (December 30, 2022 APWA GSP) 50 51
