construction operation being carried on thereunder when in violation of this <br /> Code or of any other ordinance, law or regulations or from revoking any <br /> certification of approval when issued in error. <br /> C. Section 105.1 of the 1997 Edition of the UBC is hereby amended by deleting: <br /> Section 105.1 General. In order to hear and decide appeals of orders, decisions or <br /> determinations made by the Building Official relative to the application and <br /> interpretation of this Code, there shall be and is hereby created a Board of <br /> Appeals consisting of members who are qualified by experience and training to <br /> pass on matters pertaining to building construction and who are not employees of <br /> the jurisdiction. The Building Official shall be an ex officio member of and shall <br /> act as secretary to said board but shall have no vote on any matter before the <br /> board. The Board of Appeals shall be appointed by the governing body and shall <br /> hold office at its pleasure. <br /> and inserting in its place: <br /> Section 105.1 General. For the purpose of determining suitable alternate <br /> materials, alternate types and methods of construction and reasonable <br /> interpretations regarding the UBC, any person aggrieved by an order or action of <br /> the Building Official who does not have an enforcement procedure pending <br /> pursuant to Chapter 1.20 EMC, may file a written request with the City Clerk <br /> requesting a determination by the Board of Review. The aggrieved party must file <br /> such request within thirty calendar days from the date of receipt of the written <br /> order and shall cause to be made at his own expense, any tests or research <br /> required to substantiate the request. <br /> D. Section 107.2 of the 1997 Edition of the UBC is amended by deleting the <br /> following language: <br /> The determination of value or valuation under any of the provisions of this Code <br /> shall be made by the Building Official. The value to be used in computing the <br /> building permit and building plan review fees shall be the total value of all <br /> construction work for which the permit is issued as well as all finish work, <br /> painting, roofing, electrical, plumbing heating, air conditioning, elevators, fire- <br /> extinguishing systems and any other permanent equipment. <br /> and inserting in its place: <br /> The determination of value or valuation under any of the provisions of this Code <br /> shall be made by the Building Official.
