• ^ 1 <br /> Authority to Abate <br /> 1. Any violation of the UBC is hereby declared to be a nuisance. <br /> 2. Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate action <br /> or proceeding to prevent the violation of the UBC. <br /> 3. Notwithstanding paragraph (2), the City Attorney is authorized to apply to <br /> any court of competent jurisdiction for and such court, upon hearing and <br /> for cause shown, may grant a temporary or permanent injunction <br /> restraining any person, firm and/or corporation from violating any <br /> provision of this Code and compelling compliance herewith. The cost of <br /> such action shall be taxed against the violator. <br /> 4. A conviction of any person, firm or corporation for violating this Code <br /> shall not impede the authority granted in this section to the City Attorney <br /> or City. <br /> G. Section 106.4 of the 1997 Edition of the Uniform Building Code entitled "Permit <br /> Issuance" is hereby amended by the addition of the following: <br /> 106.4.6 Violation Citation- Order <br /> Notwithstanding any language in this Code, in the event a time period is <br /> established in: 1) a violation citation issued by a Code Compliance Officer or the <br /> Building Official, or 2) an order issued by the Violations Hearing Examiner, said <br /> time period shall supersede the time period provide by this Code. <br /> Section 5: The City of Everett hereby declares that should any section, paragraph, <br /> sentence or word of this Ordinance or of the UBC or UBCS hereby adopted be declared <br /> for any reason to be invalid, it is the intent of the City of Everett that it would have <br /> passed all portions independent of the elimination herefrom of any such portion as may <br /> be declared invalid. <br /> Section 6: This Ordinance shall not be construed nor held to repeal Ordinance No.'s <br /> 2068-95, 1732-90, 1731-90, 1613-89 and 1610-89 as to any offense committed against <br /> such former ordinance or as to any act done, any penalty, forfeiture or punishment so <br /> incurred, or any right accrued or claim arising before under the former ordinance, or in <br /> any way whatever to affect any such offense or act so committed or so done, or any <br /> penalty, forfeiture or punishment so incurred or any right accrued or claim arising before <br /> this ordinance takes effect.. <br /> Nothing contained in this section shall be construed as abating any action now pending <br /> under or by virtue of Ordinance No.'s 2068-95, 1732-90, 1731-90, 1613-89 and 1610-89 <br /> or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as <br /> 5 <br />
