2.0 REGULATORY SETTING <br /> 2.1 WETLAND AND STREAM CLASSIFICATIONS <br /> 2.1.1 Cowardin System Classifications <br /> The wetland classification applicable to this site according to the Cowardin System, as described <br /> in Classification of Wetlands and Deepwater Habitats of the United States(Cowardin 1979), are as follows: <br /> Wetland A: Palustrine, Forested, Broad-leaved Deciduous, Seasonally Flooded. <br /> 2.1.2 City of Everett Classifications <br /> Pursuant to EMC 19.37.090(C), wetlands are classified according to the Department of Ecology's <br /> (DOE) Washington State Wetland Rating System for Western Washington: 2014 Update (Hruby <br /> 2014). As described in EMC 19.37.160(A), classification of streams shall be established in <br /> accordance with the water typing rules contained in WAC 222-16-030. Protective buffers are <br /> assigned to wetlands and streams based upon these classifications, as provided in EMC <br /> 19.37.110(A) and 19.37.170(A)(3), respectively. The wetlands within the vicinity of the property <br /> are classified as follows: <br /> Wetland A— Category III: Wetland A is classified as a Category III depressional wetland with <br /> a total score of 18 points and habitat score of 5 points. Wetland A receives standard buffer of 80 <br /> feet from its delineated boundary. <br /> 2.1.3 Exemptions <br /> Pursuant to EMC 19.37.050(A)(1)(k), "legally constructed structures and improvements in existence onjanuary <br /> 13, 1990, that do not meet the buffer requirements of this chapter may be remodeled, reconstructed, expanded or <br /> replaced;provided, that the new construction or related activity does not further alter or increase the impact to the <br /> critical area or buffer as a result of the proposed modification." Based on this exemption, the existing <br /> developed/improved areas (SFR, fence, yard, etc.) that are located within the standard required <br /> buffer may be remodeled, reconstructed, expanded, or replaced as long as they do not further alter <br /> or increase impacts to critical areas or buffers. These areas are shown on the map in Appendix C. <br /> 2.2 THREATENED AND ENDANGERED SPECIES <br /> Based on review of publicly available resources (Snohomish County Bull Trout and Chinook <br /> Salmon distribution maps), no development is proposed, and no clearing activities occurred in the <br /> primary association area of a critical species. For this reason, no habitat management plan has <br /> been prepared for this property. <br /> 2.3 SPECIAL FLOOD HAzARn AREAS <br /> FEMA has delineated special flood hazard areas and risk zones, which are identified on FEMA's <br /> Flood Insurance Rate Maps (FIRMs).
