firm or corporation who violates any provision of this Code shall be subject to <br /> said enforcement procedures. Provided, however, notwithstanding language <br /> to the contrary, any violation citation issued concerning a violation of this <br /> Code shall be issued by the Building Official or his/her designee who shall be <br /> the Code Compliance Director's designee for the purposes of this Code. <br /> b. Any person, firm or corporation who violates any provision of this Code shall <br /> be deemed guilty of a misdemeanor, and each such person, firm or corporation <br /> shall be deemed guilty of a separate offense for each and every day or portion <br /> thereof during which any violation of any of the provisions of this firm or <br /> corporation shall be punishable for a fine not to exceed one thousand dollars, <br /> or imprisonment in jail not to exceed ninety days, or by both such fine and <br /> imprisonment. <br /> c. The enforcement provisions and procedures provided in this Code are not <br /> exclusive and the City is authorized to pursue any remedy it deems <br /> appropriate or as otherwise provided by law. <br /> d. The issuance or granting of a permit or approval of plans and/specifications <br /> shall not be deemed or construed to be a permit for, or an approval of, any <br /> violation of any of the provisions of this Code or any other law or regulation. <br /> No permit presuming to give authority to violate or cancel the provisions of <br /> this Code shall be valid, except insofar as the work or use, which it authorized, <br /> is lawful. <br /> e. The issuance or granting of a permit or approval of plans and/or specifications <br /> shall not prevent the Building Official or designee from thereafter requiring <br /> the correction of errors in said plans and/or specifications or from preventing <br /> construction operation being carried on thereunder when in violation of this <br /> Code or of any other ordinance, law or regulation or from revoking any <br /> certificate of approval when issued in error. <br /> D. Chapter 1 of the 1997 edition of the Uniform Plumbing Code is hereby amended <br /> by adding the following: <br /> 102.3.3 Board of Review <br /> For the purpose of determining suitable alternate materials, alternate types and <br /> methods of construction and reasonable interpretations regarding the Uniform <br /> Plumbing Code, any person aggrieved by an order or action of the Building <br /> Official who does not have an enforcement procedure pending pursuant to <br /> Chapter 1.20 EMC, may file a written request with the City Clerk requesting a <br /> determination by the Board of Review. The aggrieved party must file such <br /> request within thirty calendar days from the date of receipt of the written order <br /> and shall cause to be made at his own expense, any tests or research required to <br /> substantiate the request. <br /> E. Section 203 of the 1997 Edition of the Uniform Plumbing Code is hereby <br /> amended by deleting the following: <br /> 3 <br />
