e 1 Section 3 Said pipes shall be laid dwon in such manner 2 as not to interfere with the sewer and water pipes, gas main, 3 telephone or telegraph conduits or any of the pipes of said city , 4 or with any pipes that have been laid down heretofore in said 5 streets, avenues, alleys or public places under the authority of 6 the city, and the system of pipes to be laid down by said grantee 7 hereunder shall be first class in every respect; and the said 8 grantee, his heirs, administrators and assigns , shall have the 9 right to charge and collect reasonable compensation from all 10 persons and corporations to whom it shall furnish steam, water, 11 and heat for any of the purposes authorized by this ordinance. 12 Section 4 The rights and privileges granted in this 13 ordinance shall not be exclusive, but the city may grant such 14 rights to any person or persons, or corporations, and may make 15 any number of such grants and the said. city reserves the right to 16 use said streets, alleys, avenues and other public places itself 17 for such purposes. 18 Section 5 The right, privilege and franchise herein 19 granted shall continue and be in force until the 20th day of 20 January , 1950, and. this franchise shall have no effect after 21 that date. 22 Section 6 In consideration of the rights herein granted 23 the said grantee, his heirs, administrators and assigns, agrees 24 to pay to the city of Everett, annually, a sum equal to 2 of the 25 gross earnings from the operat ion of and the sale of the products 26 of the pipelines herein mentioned, this payment to be made upon 27 the sworn statement of grantee, his heirs, administrators met or 28 assigns, to be filed with the city clerk, and the city clerk or 29 any committee appointed by the city council for that purpose shall 30 have the right to examine the books of the grantee, his heirs, x 31 administrators or assigns, and to verify the correctness of said.
