IP' •b.► S 411. 1 statement, and to correct the same if found erroneous; and if 2 said statement shall be corrected, then said, payment shall be 3 adjusted upon said corrected statement . 4 Section 7 This franchise is made expressly subject to 5 the condition that the city council shall have the right with 6 respect to said franchise 7 a. To hear and determine what are just, fair and 8 reasonable rates and charges for public service , and to order 9 that . nly reasonable charges shall be imposed . The granting of 10 this franchise shall not be deemed to confer any right to include ! 11 in the charge for service any return upon the value of the 12 franchise so granted. 13 b. To require reasonable extensions of such public 14 service system. 15 c . To make such rules and regulations as may be required 16 to secure adequate and proper service. 17 If the grantee, his heirs , administrators or assigns, 18 against whom any order is directed under the provision of a, 19 b or c, of this section shall believe such order to be unjust 20 or unreasonable, he or it may test its justness or reasonableness 21 by a proper action in the courts, commenced within thirty days 22 after service of such order; and in such action such order may 23 be entered in the premises as shall be warranted by the facts 24 developed upon the trial and. the law applicable thereto. 25 Section 8. The grantee herein, his heirs, administrators 26 and as signs , operating under this franchise shall submit to the 27 council within 60 days after the first day of January of each 28 year, an annual report, properly verified . Such report shall 29 contain such detailed information as nay be prescribed by the 30 council by ordinance .
