The Compaction Price Adjustment will be calculated as the 3 product of CPF, the quantity of HMA in the compaction control lot in tons, and the unit 4 Contract price per ton of mix. 5 6 5-04.3(11) Reject Work 7 8 5-04.3(11)A Reject Work General 9 Work that is defective or does not conform to Contract requirements shall be rejected. 10 The Contractor may propose, in writing, alternatives to removal and replacement of 11 rejected material. Acceptability of such alternative proposals will be determined at the 12 sole discretion of the Engineer. HMA that has been rejected is subject to the 13 requirements in Section 1-06.2(2) and this specification, and the Contractor shall submit 14 a corrective action proposal to the Engineer for approval. 15 16 5-04.3(11)B Rejection by Contractor 17 The Contractor may, prior to sampling, elect to remove any defective material and 18 replace it with new material. Any such new material will be sampled, tested, and 19 evaluated for acceptance. 20 21 5-04.3(11)C Rejection Without Testing (Mixture or Compaction) 22 The Engineer may, without sampling, reject any batch, load, or section of Roadway that 23 appears defective. Material rejected before placement shall not be incorporated into the 24 pavement. Any rejected section of Roadway shall be removed. 25 26 No payment will be made for the rejected materials or the removal of the materials 27 unless the Contractor requests that the rejected material be tested. If the Contractor 28 elects to have the rejected material tested, a minimum of three representative samples 29 will be obtained and tested. Acceptance of rejected material will be based on 30 conformance with the nonstatistical acceptance Specification. If the CPF for the rejected 31 material is less than 0.75, no payment will be made for the rejected material; in addition, 32 the cost of sampling and testing shall be borne by the Contractor. If the CPF is greater 33 than or equal to 0.75, the cost of sampling and testing will be borne by the Contracting 34 Agency. If the material is rejected before placement and the CPF is greater than or equal 35 to 0.75, compensation for the rejected material will be at a CPF of 0.75. If rejection 36 occurs after placement and the CPF is greater than or equal to 0.75, compensation for 37 the rejected material will be at the calculated CPF with an addition of 25 percent of the 38 unit Contract price added for the cost of removal and disposal. 39 40 5-04.3(11)D Rejection - A Partial Sublot 41 In addition to the random acceptance sampling and testing, the Engineer may also 42 isolate from a normal sublot any material that is suspected of being defective in relative 43 density, gradation or asphalt binder content. Such isolated material will not include an 44 original sample location. A minimum of three random samples of the suspect material will 45 be obtained and tested. The material will then be statistically evaluated as an 46 independent lot in accordance with Section 1-06.2(2). 47 48
