Edgewater Creek Bridge Replacement November 2023 28 In cases of conflict between different safety regulations, the more stringent regulation 1 shall apply. 2 3 The Washington State Department of Labor and Industries shall be the sole and 4 paramount administrative agency responsible for the administration of the provisions of 5 the Washington Industrial Safety and Health Act of 1973 (WISHA). 6 7 The Contractor shall maintain at the project site office, or other well known place at the 8 project site, all articles necessary for providing first aid to the injured. The Contractor 9 shall establish, publish, and make known to all employees, procedures for ensuring 10 immediate removal to a hospital, or doctor’s care, persons, including employees, who 11 may have been injured on the project site. Employees should not be permitted to work 12 on the project site before the Contractor has established and made known procedures 13 for removal of injured persons to a hospital or a doctor’s care. 14 15 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of 16 the Contractor’s plant, appliances, and methods, and for any damage or injury resulting 17 from their failure, or improper maintenance, use, or operation. The Contractor shall be 18 solely and completely responsible for the conditions of the project site, including safety 19 for all persons and property in the performance of the work. This requirement shall apply 20 continuously, and not be limited to normal working hours. The required or implied duty of 21 the Engineer to conduct construction review of the Contractor’s performance does not, 22 and shall not, be intended to include review and adequacy of the Contractor’s safety 23 measures in, on, or near the project site. 24 25 The Contractor shall be in compliance at all times with all governmental laws, regulations, 26 requirements, and orders relating to COVID-19 applicable to the Work, including without 27 limitation OSHA, L&I or other safety rules relating to COVID-19 and COVID-19 28 gubernatorial proclamations and orders. These laws, regulations, requirements, and 29 orders are referred to as “COVID-19 Requirements. 30 31 Contractor’s Bid includes all costs necessary for the duration of the Work for compliance 32 with COVID-19 Requirements. Contractor’s Bid takes into account that COVID-19 33 Requirements may create direct and indirect costs, including inefficiency and delay. 34 35 Contractor shall have no entitlement to an equitable adjustment or other increase to the 36 Contract Sum for any direct or indirect costs (including without limitation delay, cumulative 37 impact, inefficiency or ripple costs) incurred by the Contractor to comply with COVID-19 38 Requirements. 39 40 1-07.2.RTF 41 1-07.2 State Taxes 42 43 Delete this section, including its sub-sections, in its entirety and replace it with the following: 44 45 1-07.2 State Sales Tax 46 (June 27, 2011 APWA GSP) 47 48 The Washington State Department of Revenue has issued special rules on the State 49 sales tax. Sections 1-07.2(1) through 1-07.2(3) are meant to clarify those rules. The 50 Contractor should contact the Washington State Department of Revenue for answers to 51
