<br /> operation, modification, repair, maintenance, management, and removal of Lessee's
<br /> telecommunications facility(including,without limitation, equipment designed to transmit
<br /> and receive radio frequency signals) (collectively, "Lessee's Equipment"), which shall
<br /> include the right to replace, repair, add, or otherwise modify any or all of Lessee's
<br /> Equipment and the frequencies over which Lessee's Equipment operates; provided
<br /> however that Lessee's use, acts or omissions shall not conflict or interfere with the Third
<br /> Party's or Additional Collocator's use of the Site, Tower and related equipment or
<br /> improvements ("Lessee's Permitted Use"). Lessee shall have the right to remove any or
<br /> all of Lessee's Equipment from the Premises at any time during the Term. Lessor
<br /> acknowledges that Lessee shall have the right to install radio frequency signs and
<br /> barricades at the Site as may be required by applicable law;provided,however,that Lessee
<br /> may not install barricades outside of the Premises without prior written notice to Lessor.
<br /> Lessee shall use commercially reasonable efforts to install any required signage and/or
<br /> barricades in a location(s) that is acceptable to Lessor but only if Lessor's desired location
<br /> complies with Applicable Law or any Governmental Approval.
<br /> b. CONSENT REQUIRED. Lessee acknowledges and agrees that Lessee's use of the Tower
<br /> and the Site, and Lessee's activities thereon, may require prior consent of the Third Party.
<br /> Notwithstanding anything in this Lease to the contrary, Lessee further warrants and
<br /> represents that it has obtained or will obtain consent from, and will comply with, any
<br /> procedures and requirements imposed by the Third Party for each act or omission subject
<br /> to such consent, procedures, or requirements. As an illustration, but not limitation, Lessee
<br /> shall obtain consent from the Third Party, as the case may be, to install or modify Lessee's
<br /> Equipment on the Tower. Lessee further agrees to defend, indemnify and hold harmless
<br /> Lessor from any Claims (as defined herein) that may arise, in whole or in part, from a
<br /> failure by Lessee, its officers, owners, members, managers, employees, agents,
<br /> representatives, contractors and subcontractors or any other person or entity for whom
<br /> Lessee is legally responsible, to obtain consent from, or comply with procedures and
<br /> requirements imposed by the Third Party.
<br /> 5. ACCESS AND UTILITIES ROUTE. Lessor grants to Lessee a non-exclusive right to use
<br /> certain additional non-exclusive space for access and utilities as more particularly described
<br /> and depicted on Exhibit B ("Access and Utilities Route"). Lessor agrees that providers of
<br /> utility or fiber services may use any existing easements, over, under, and across the Property
<br /> for utilities, fiber and access to the Premises for the installation of any equipment necessary to
<br /> provide utility or fiber service. If the existing utility or fiber sources located within the
<br /> Premises or on the Property are insufficient for Lessee's Permitted Use then Lessor agrees to
<br /> grant Lessee and/or the applicable third party utility or fiber provider the right, at Lessee's sole
<br /> cost and expense, to install such utilities or fiber on, over and/or under the Property as is
<br /> necessary for Lessee's Permitted Use; provided that Lessor and Lessee shall mutually agree in
<br /> writing on the location of such installation(s).
<br /> 6. PERMITTED INSTALLATION; MODIFICATION; AND GOVERNMENTAL
<br /> APPROVALS.
<br /> a. PERMITTED INSTALLATION. All work done by Lessee at the Property shall be done
