D. Contractor's Failure to Recover Lost Time: <br />1. Contractor's refusal, failure, or neglect to take appropriate measures to recover lost time, or <br />to submit a recovery schedule, shall constitute reasonable evidence that Contractor is not <br />prosecuting the Work, or designated part of the Work, with diligence to ensure completion <br />in accordance with the Contract time.
