4. Disqualification. Not be disqualified from bidding on any public works contract under <br />RCW 39.06.010 or 39.12.065(3). <br />5. Prevailing Wage Training. Unless Bidder has completed three or more public works <br />projects and had a valid business license for three or more years, Bidder must have <br />received Department of Labor and Industries training on the requirements related to <br />public works and prevailing wage under RCW 39.12 and RCW 39.04. <br />5. Certification of Wage Compliance. Within the three-year period immediately preceding <br />the date of the bid solicitation, not have been determined by a final and binding citation <br />and notice of assessment issued by the Department of Labor and Industries or through <br />a civil judgment entered by a court of limited or general jurisdiction to have willfully <br />violated, as defined in RCW 49.48.082, any provision of Chapter 49.46, 49.48, or 49.52 <br />RCW. <br />6. Apprentices. This project is subject to a 15% apprenticeship requirement, defined as <br />15% of the total labor hours on the project must be performed by apprentices in <br />accordance with Section 00 73 73 of the specifications. <br />1-02.1(2) Supplemental Bidder Responsibility Criteria <br />If this Project is subject to supplemental bidder responsibility criteria, then such criteria will be <br />contained in SECTION 00 22 13, SUPPLEMENTAL INSTRUCTIONS TO BIDDERS. If there is <br />no SECTION 00 22 13, SUPPLEMENTAL INSTRUCTIONS TO BIDDERS in the bid package, <br />then the Project is not subject to supplemental bidder responsibility criteria. <br />1-02.2 Plans and Specifications <br />Information as to where bid documents can be obtained or reviewed will be found in the Call for <br />Bids (Advertisement for Bids) for the Work. <br />1-02.3 Not Used <br />1-02.4 Examination of Plans, Specifications, and Site of Work <br />1-02.4(1) General <br />The Bidder shall carefully examine the Contract Documents. Submittal of a Bid shall be <br />conclusive evidence that the Bidder has made these examinations and understands all <br />requirements for the performance of the completed Work. The Bidder further warrants, agrees, <br />and acknowledges by submitting a Bid that it: <br />1. Has taken steps reasonably necessary to ascertain the nature and location of the <br />Work, including without limitation the actual physical conditions of and at the location, <br />surface and subsurface conditions, and conditions ordinarily to be encountered and <br />generally recognized as inherent in the Work; <br />2. Has investigated and satisfied itself as to the general and local conditions which can <br />affect the Work or its cost, including but not limited to: <br />a. Conditions bearing upon acquisition, transportation, disposal, handling, and <br />storage of materials; <br />b. The availability of labor, materials, services, utilities (including without limitation <br />water and electric power), and roads; <br />c. Uncertainties of weather, river stages, tides, or similar physical conditions at the <br />site; <br />d. The conformation and condition of the ground; <br />e. The character of equipment and facilities needed preliminary to and during Work <br />performance; <br />f. The site biological hazards and associated physical hazards; <br />g. Access to the Site; <br />h. Environmental factors; and <br />i. All other data, matters and things requisite to the fulfillment of the Work. <br />3.
