this area. The City will not adjust its payment if the Contractor bases a Bid on a misunderstood tax <br />liability. The Contractor shall not include State retail sales taxes in the unit bid prices. A separate line <br />item for applying State retail sales tax is provided in the Bid Form. <br />Limitations Regarding Contractor's Claim for Damages <br />Bidders should review the Contract Documents regarding limitations on claims for damages. <br />Delays and Interference <br />Bidders should review the Contract Documents regarding delays and interference. <br />Business License <br />A City of Everett business license is required for the Contractor and Subcontractors performing Work <br />on this Project. <br />BIDDER'S CHECKLIST <br />Forms for Submission with the Bid <br />The Bidder's attention is especially called to the following forms that must be executed in full as <br />required and submitted with the Bid. <br />1. Bid Form: Show the lump sum and unit price items in the spaces provided on the Bid Form. <br />To be filled in and signed by the Bidder <br />2. Subcontractors Form: To be filled in by the Bidder, if required by these Instructions. <br />3. Bid Security: This form is to be executed by the Bidder and the surety company unless Bid <br />is accompanied by a certified or cashier's check, as required by these instructions. The <br />amount of the bond or cashier's check, which shall be not less than five percent of the Total <br />Bid Amount, may be shown in dollars or on a percentage basis. <br />4. RCW 35.22.650 Certification: To be filled in and signed by the Bidder. <br />5. Non -Collusion Affidavit: To be signed, notarized and submitted with the Bid. <br />Failure to complete and fully execute the aforementioned forms and to submit them with the Bid <br />may result in rejection of Bid. <br />Forms for Submission after Award of Contract <br />The following forms are to be executed after the award of Contract: <br />1. Contract: This Contract to be executed by the successful Bidder with the City's AdobeSign <br />system within 14 calendar days after the award date. <br />2. Payment and Performance Bonds: These forms are to be executed by the successful <br />Bidder and the Bidder's surety company. The amount of these bonds shall be 100 percent <br />of the Total Bid and shall be submitted with the Contract. <br />3. Proof of Insurance: Insurance certificates and endorsements shall be obtained and <br />maintained in force in accordance with SECTION 00 72 00, Part 15 "Liability and <br />Insurance", of the Contract Documents. <br />4. Power of Attorney: Attorneys -in -fact who sign bid bonds or contract bonds must file with <br />each bond a certified and effectively dated copy of their Power of Attorney. <br />5. Statement of Intent to Pay Prevailing Wage (L&I Form F700-029-000) and Affidavit of <br />Wages Paid (F700-007-000) from the Contractor, Subcontractor and agents to the <br />Subcontractor shall be submitted to the Employment Standards Division, State Department <br />of Labor and Industries, Olympia, Washington. If the prime contract is over $1,000,000, <br />then Contractor also needs to submit L&I Form F700-164-000 (Affidavit of Wages Paid <br />EHB 2805 Addendum). <br />6. Weekly Statement with Respect to Payment of Wages (U.S. Dept of Labor Form WH347): <br />Contractors, Subcontractors, and agents to Subcontractors using Payroll Form WH347 <br />may use State of Compliance found on the back of the form. <br />7. Weekly Statement of Compliance (U.S. Dept of Labor Form WH348). Contractors, <br />Subcontractors, or agents to Subcontractors not using Payroll Form WH347 shall attach <br />the Statement of Compliance Form WH348 to each payroll. <br />8.
