City of Everett 00 2113 - 11 <br /> <br /> <br />Instructions to Bidders <br />002113-11 202082-10 May 2024 <br />pw://Carollo/Documents/WA/Everett/202082-100000/04 Design/04 Specs/Carollo/002113 (FS-100) <br /> <br />Within 15 calendar days after the Bids are opened, the City will return the bid deposit <br />accompanying the Bids that are not to be considered in making the Award. <br />1-03.7 Judicial Review <br />All protests by Bidders must be in accordance with Chapter 3.46 of the Everett Municipal <br />Code, “Bid Protest Procedures.” <br />The exclusive venue of all lawsuits shall be in Snohomish County Superior Court. <br />OTHER MATTERS <br />Time of Completion <br />The Contractor shall complete the Work on or before the date or dates specified in <br />Section 00 5213 - AGREEMENT FORM. <br />Equal Employment Opportunity <br />The Contractor will be required to assure that equal employment opportunities will be in effect <br />to all individuals throughout the duration of this Contract, pursuant to SECTION 00 7200, <br />Part 7 “Labor Standards,” of the Contract Documents. The Contractor must comply with all <br />local, State and Federal laws pertaining to non-discrimination and equal employment <br />opportunity. <br />Sales Tax <br />The Washington State Department of Revenue has issued special rules on the State sales <br />tax. The Contractor should contact the Washington State Department of Revenue for <br />answers to questions in this area. The City will not adjust its payment if the Contractor bases <br />a Bid on a misunderstood tax liability. The Contractor shall not include State retail sales taxes <br />in the unit bid prices. A separate line item for applying State retail sales tax is provided in the <br />Bid Form. <br />Limitations Regarding Contractor’s Claim for Damages <br />Bidders should review the Contract Documents regarding limitations on claims for <br />damages. <br />Delays and Interference <br />Bidders should review the Contract Documents regarding delays and interference. <br />Business License <br />A City of Everett business license is required for the Contractor and Subcontractors <br />performing Work on this Project. <br />BIDDER’S CHECKLIST <br />Forms for Submission with the Bid <br />The Bidder’s attention is especially called to the following forms that must be executed in <br />full as required and submitted with the Bid. <br />1. Bid Form: Show the lump sum and unit price items in the spaces provided on the <br />Bid Form. To be filled in and signed by the Bidder. <br />2. Document 00451F Cured-In-Place Pipe Rehabilitation Qualifications Form: To be <br />filled in by Bidder. <br />3. Document 00451G Cured-In-Place Manhole Rehabilitation Qualifications Form: To <br />be filled in by bidder. <br />4. Subcontractors Form: To be filled in by the Bidder, if required by these Instructions.
