<br /> <br /> <br /> <br /> <br /> <br /> <br />ORDINANCE NO. <br /> <br />An ORDINANCE Relating to the Park District, Adopting a Planned Development Overlay under Chapter <br />19.29 EMC and Approving a Development Agreement <br /> <br />WHEREAS, <br />A. The Everett Housing Authority (“EHA”) owns or controls property located in the Delta <br />neighborhood of north Everett. The EHA wishes to develop this property with a planned <br />development as described in more detail below called the “Park District” (sometimes also <br />referred as the “Project”). <br />Purposes and Organization of Ordinance <br />B. One purpose of this Ordinance is to approve a planned development overlay for Park District <br />under chapter 19.29 EMC. According to EMC 19.29.010: <br /> This chapter establishes a mechanism for a property owner to propose a residential, <br />commercial, industrial, or mixed-use development that is innovative or otherwise beneficial <br />to the community but which does not strictly comply with the provisions of the zone in which <br />the property is located. This mechanism is called a planned development overlay (“PDO”) and <br />is intended to promote high quality developments which benefit the city more than would a <br />development which complies with the specific requirements of this title, while allowing <br />greater flexibility in the design of such developments. <br />EMC 19.29.040 allows for modification of permitted uses, while EMC 19.29.050 allows <br />modification of development standards. <br />C. The Park District planned development overlay (the “PDO”) contains the following elements, <br />which are exhibits attached to this Ordinance: <br />Exhibit A.1, which contains modifications to Title 19 EMC for the Park District <br />Exhibit A.2, which contains the “Park District Design Standards” <br />Exhibit B, which contains the legal description of the Park District. This property is referred <br />to in this ordinance as the “Property” and is the property to which the PDO applies. <br />Exhibit C, which contains the “Preliminary Development Plan” <br />D. A second purpose of this Ordinance is to approve a development agreement for the Park District <br />under RCW 36.70B.170 et seq and EMC 15.03.200.
