Chapter 19.04 EMC, Definitions Page 24 of 55 <br />The Everett Municipal Code is current through Ordinance 4031-24, passed May 22, 2024. <br />“Entertainment and recreation, enclosed” means an entertainment or recreation facility under <br />private ownership and operated by a for-profit or nonprofit organization, and providing one or <br />more of the following types of entertainment activities: cinemas, billiard parlors, nightclubs, <br />coin-operated arcades, bowling alleys, ice skating and roller skating; one or more of the <br />following types of recreation facilities: fitness center, indoor gymnasium, spa or health club, <br />including tennis, handball, golf, squash, volleyball, racquetball, badminton, skate park and <br />swimming. The use does not include adult use business, adult retail or adult entertainment as <br />defined in this title. <br />“Entertainment and recreation, not enclosed” means an entertainment or recreation facility <br />under private ownership and operated by a for-profit or nonprofit organization and providing <br />one or more of the following types of entertainment activities: ice skating; skate park and <br />swimming; or commercial outdoor recreation, including golf courses, archery range, or similar <br />use. <br />“Equipment sales and rental” means service industry providing machinery, equipment and tools <br />of all kinds and sizes (from earthmoving to powered access, from power generation to <br />hand-held tools, etc.) for a limited period of time to final users, mainly to construction <br />contractors but also to industry and individual consumers. <br />“Food or beverage establishment” means restaurants, cafes, and similar types of land uses that <br />prepare and serve edible goods for consumption by the customer including beverage service. <br />“Heavy truck and equipment sales” means a business where new or used trucks over eighteen <br />thousand pounds are displayed for sale, typically outdoors on a paved parking lot. This use may <br />include a showroom and/or service facility. <br />“Hotel” or “motel” means a transient accommodation offering three or more lodging units to <br />guests for periods of less than thirty days, and may also provide incidental services such as <br />restaurants, meeting rooms or recreational facilities. <br />“Impound, storage, tow yard” means a lot used for the temporary storage of vehicles which <br />have been towed by a towing company or for impounded vehicles, but which does not include <br />permanent vehicle storage or dismantling of vehicles. <br />“Kennel, commercial” means an establishment that houses, cares for, breeds, or raises dogs, <br />cats or other small domestic animals for profit.
