Chapter 19.04 EMC, Definitions Page 34 of 55 <br />The Everett Municipal Code is current through Ordinance 4031-24, passed May 22, 2024. <br />“Community center” means a building or other enclosed structure open to the general public <br />that is owned and operated by a public agency or nonprofit corporation, organization or <br />association registered by Washington State, and that is used primarily for cultural, educational, <br />recreational, or social purposes, and may include other minor supporting uses or activities. Not <br />included in the category of community center as a primary use are those businesses and <br />occupations defined by this title as clinics, government administrative offices or uses such as <br />churches, schools, private clubs or fraternal organizations. <br />“Greenhouse” or “nursery” means a site where trees, shrubs and other plant materials are <br />grown, propagated and/or stored for the purpose of retail or wholesale sales. <br />“Marijuana,” “marijuana processor,” “marijuana producer,” and “marijuana retailer” shall have <br />the meanings set forth in RCW 69.50.101: <br />1. “Marijuana” or “marihuana” means all parts of the plant Cannabis, whether growing or <br />not, with a THC concentration greater than 0.3 percent on a dry weight basis; the seeds <br />thereof; the resin extracted from any part of the plant; and every compound, manufacture, <br />salt, derivative, mixture, or preparation of the plant, its seeds or resin. The term does not <br />include: <br />a. The mature stalks of the plant, fiber produced from the stalks, oil or cake made <br />from the seeds of the plant, any other compound, manufacture, salt, derivative, <br />mixture, or preparation of the mature stalks (except the resin extracted therefrom), <br />fiber, oil, or cake, or the sterilized seed of the plant which is incapable of germination; <br />or <br />b. Hemp or industrial hemp as defined in RCW 15.140.020, seeds used for licensed <br />hemp production under Chapter 15.140 RCW. <br />2. “Marijuana processor” means a person licensed by the state Liquor and Cannabis Board <br />to process marijuana into marijuana concentrates, usable marijuana, and <br />marijuana-infused products, package and label marijuana concentrates, usable marijuana, <br />and marijuana-infused products for sale in retail outlets, and sell marijuana concentrates, <br />usable marijuana, and marijuana-infused products at wholesale to marijuana retailers.
