Chapter 19.04 EMC, Definitions Page 36 of 55 <br />The Everett Municipal Code is current through Ordinance 4031-24, passed May 22, 2024. <br />This definition excludes secondhand stores, pawnshops, thrift stores and artwork made from <br />recycled or previously used materials incorporated into artwork. The planning director is <br />authorized to maintain a list of stores that qualify as junk stores. <br />“Pawnshop” means an establishment that engages, in whole or in part, in the business of <br />loaning money on the security of pledges of personal property, or deposits or conditional sales <br />of personal property, or the purchase or sale of personal property. <br />“Secondhand store” means retail sales of previously used merchandise, the majority of which is <br />not donated, such as clothing, furniture, appliances, household goods, sporting goods, <br />recreational equipment or other merchandise not considered to be antique, that is in good <br />repair or has been restored or reconditioned to a clean and usable condition. This definition <br />excludes “pawn shop,” “thrift store,” and “junk store.” The planning director is authorized to <br />maintain a list of stores that qualify as secondhand stores. <br />“Specified anatomical areas” means: <br />1. Less than completely and opaquely covered human genitals, pubic region, buttock and <br />female breast below a point immediately above the top of the areola; and <br />2. Human male genitals in a discernible turgid state, even if completely and opaquely <br />covered. <br />“Specified sexual activities” means: <br />1. Human genitals in a state of sexual stimulation or arousal; <br />2. Acts of human masturbation, sexual intercourse or sodomy; <br />3. Fondling or other erotic touching of human genitals, pubic region, buttock or female <br />breast. <br />“Thrift store” means a store that derives the majority of its sales from donated previously used <br />merchandise such as clothing, furniture, appliances, household goods, sporting goods, <br />recreational equipment or other merchandise not considered to be antique.
