Description of Date(s): 7/10/23 <br /> Violation and codes Notice of Violation and Order was issued on 7/10/23 with a compliance <br /> violated: (Notice(s) date of 1/10/24. <br /> of Violation and/or <br /> other enforcement The non-compliant and/or illicit connections associated with the fuel <br /> document(s)issued island on the property created or allowed illicit discharges of <br /> are attached to this petroleum products into the stormwater system.The existing <br /> Agreement) conditions, and unpermitted modifications to the Stormwater drainage <br /> system, are violations of the following sections of the Everett Municipal <br /> Code (EMC). <br /> EMC Provision(s)Violated: <br /> EMC 14.28.120 Maintenance and operations of private stormwater <br /> drainage systems <br /> Maintenance of private stormwater drainage systems and <br /> infrastructure is required to ensure the ongoing effectiveness of the <br /> facilities and the protection of life and property. All private stormwater <br /> drainage systems shall be maintained by the owner or operator thereof <br /> in a safe and proper operating condition, and in compliance with all <br /> applicable requirements of this chapter and regulations and <br /> procedures adopted hereunder. The city assumes no responsibility for <br /> maintenance and operation of private stormwater drainage systems, <br /> except for private stormwater drainage systems where the city has <br /> expressly assumed maintenance and operation as provided in EMC <br /> 14.28.090 or elsewhere in this chapter. <br /> E. Any modification of an existing stormwater facility or stormwater <br /> drainage system must be approved and permitted by the city with a <br /> public works permit. Failure to obtain permits and approvals or to <br /> comply with conditions thereof for any such alteration constitutes a <br /> violation of this chapter. (Ord. 3880-22 §4 (Exh. A), 2022.) <br /> EMC 14.28.130 Source Control Requirements <br /> A. New and redevelopment projects and existing businesses shall <br /> include all known, available and reasonable source control BMPs. <br /> Source control BMPs shall be selected, designed, applied, and <br /> maintained in accordance with EMC 14.28.030. <br /> B. Source control BMPs shall be applied to any activity that might <br /> discharge contaminants to the stormwater drainage system, surface or <br /> ground water. <br /> 1. Application of operational source control BMPs (and if necessary <br /> structural source control BMPs or treatment BMPs/facilities, or both) <br /> to pollution generating sources shall be maintained in a safe and <br /> Page 2 of 8 <br />
