The city shall have the right to enter the property for the purposes <br /> of inspecting source control BMPS at public and privately owned <br /> institutional, commercial, multifamily and industrial sites and take such <br /> actions as may be required to enforce the provisions of this chapter. <br /> 3. The director may require the application of operational or structural <br /> source control BMPs at any time through code enforcement where <br /> necessary to prevent illicit discharges. <br /> 4. Failure to implement source control BMPs shall constitute a <br /> violation of this chapter and result in enforcement action. (See EMC <br /> 14.28.150.) (Ord. 3880-22 §4(Exh.A), 2022.) <br /> EMC 14.28.140 Illicit Discharges and Connections <br /> D. Failure to Remove Pollutants from Private System. It shall be a <br /> violation of this chapter for any person who commits an illicit or <br /> conditional discharge in violation of this section to fail to remove the <br /> pollutants from a private system that enters the stormwater drainage <br /> system and/or surface and ground waters. In addition, it shall be a <br /> violation of this chapter for any property owner on whose property an <br /> illicit or conditional discharge occurs to fail to remove the pollutants <br /> from a private system that enters the stormwater drainage system or <br /> surface and ground water. <br /> E. Prohibition of Illicit Connections. <br /> 1. The construction, use, maintenance, or continued existence of illicit <br /> connections to the stormwater drainage system is prohibited and <br /> constitutes a violation of this chapter. <br /> 2. This prohibition expressly includes, without limitation, illicit <br /> connections made in the past, regardless of whether the connection <br /> was permissible under law or practices applicable or prevailing at the <br /> time of connection. <br /> *** <br /> Corrective Action(s) By November 11, 2024: <br /> Required and • Submit a complete Public Works Permit application for all of the <br /> Compliance necessary and required permits and approvals,the create a Permanent <br /> Schedule for Drainage Solution,to bring the property and structure(s)on the property <br /> Corrective Action(s) into compliance with the Everett Municipal Code. Information on the City <br /> of Everett permit application process can be found at <br /> www.everettwa.gov/permits <br /> • Once the Public Works Permit is issued,then correct and complete all of <br /> the deficiencies that are present on the property and/or within the <br /> structure(s)and have the work inspected and approved, by the Everett <br /> City Building and Public Works Divisions. <br /> Page 3 of 8 <br />
