Y <br /> ORDINANCE NO. 2389-99 <br /> AN ORDINANCE amending the Zoning Map of the City of Everett as provided by <br /> Ordinance No. 1671-89 as amended (Title 19, Everett Municipal Code) rezoning the <br /> area generally described as Parcel I of the Southern boundary of the Everett Mall <br /> Property, and consisting of that portion of the Northwest quarter of the Northeast <br /> quarter of Section 19, Township 28 north, Range 5 East, W.M. and superceding <br /> Ordinance No. 766-81. <br /> Whereas, the City Council finds that on January 22, 1999 and March 25, 1999, <br /> the City of Everett's Land Use Hearing Examiner held public hearings regarding a <br /> proposed rezone of the above referenced property from C-1 with contract to a straight <br /> C-1 zone; and <br /> Whereas, the Hearing Examiner based upon testimony and information presented <br /> at the public hearings recommends the rezone of the subject property from C-1 with <br /> contract to a straight C-1 zone; and <br /> Whereas, the City Council finds that the best interests of the health, safety and <br /> welfare of the citizens of Everett will be met by this rezone; and <br /> Whereas, the City Council finds that the hereinafter described property should be <br /> rezoned to C-1, General Commercial; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the City Council does hereby find that the zoning change hereinafter set <br /> forth is consistent with the applicable provisions of the Everett General Plan; bears a <br /> substantial relation to the public health, safety and welfare; and promotes the best long <br /> term interests of the Everett community. <br /> Section 2: That the Zoning Map of the City of Everett, as established by Ordinance <br /> No. 1671-89 as amended (Title 19, Everett Municipal Code), is hereby amended from <br /> C-1 with contract to C-1, General Commercial, for the following described property: <br /> PARCEL 1: <br /> That portion of the Northwest quarter of the Northeast quarter of Section 19, <br /> Township 28 North, Range 5 East, W.M., described as follows: <br />
