Beginning at the Northeast corner of said subdivision; Thence N86°49'05"W along the North line thereof 347.60 feet to the True North point of beginning; Thence S02°10'55"W 345.00 feet; Thence N87°49'05"W 604.71 feet to the East line of the Puget Sound Power and Light Company Right-of-Way, now held of record by Public Utility District No. 1 of Snohomish County and established by deed recorded under recording No. 178970; Thence North along said East line 345.00 feet to the North line of said subdivision; Thence East along said North line 604.71 feet to the True point of beginning. Together with that portion of said Northwest quarter of the Northeast quarter lying West of said Puget Sound Power and Light Company of Right-of-Way and lying Easterly and Northerly of the Northeasterly line of a road strip being 60.00 feet in width lying 30.00 feet on each side of the following described centerline: Beginning at the Northwest corner of said subdivision; Thence S00°08'24"E along the West line thereof 30.03 feet; Thence S87°49'05"E 33.13 feet to a point on the centerline of said parcel of land also being the True point of beginning; Thence S23°19'05"E 195.43 feet to the beginning of a tangent curve concave Northeasterly; Thence along said curve having a radius of 275.00 feet through a central angel of 49°31'17" an arc distance of 237.69 feet to a point on the Westerly line of said Puget Sound Power and Light Company Right-of-Way and the terminus of said centerline. Section 3: That the Official Map in the Planning Department of the City of Everett shall be amended as herein above provided, and said property shall be used in accordance with the zone in which the same is now established, as provided by Ordinance No. 1671-89 as amended (Title 19, Everett Municipal Code). Section 4: That Ordinance No. 766-81 (Rezone No. 4-80) is hereby superceded and the concomitant agreement authorized by Ordinance No. 766-81 is hereby vacated. Section 5: That the City Clerk is hereby instructed to file a duly certified copy of this ordinance with the Auditor of Snohomish County, Washington. Section 6: That the enactment of this Ordinance shall not affect any case, proceeding, appeal or other matter currently pending before the City or in any court, or waive any right of the City in existence at the time of passage of this Ordinance. 2
