18TH STREET PEDESTRIAN IMPROVEMENTS 3741 RMT July 03, 2024 9 1-03.1.rtf 1 1-03.1 Consideration of Bids 2 (December 30, 2022 APWA GSP) 3 4 Revise the first paragraph to read: 5 6 After opening and reading proposals, the Contracting Agency will check them for 7 correctness of extensions of the prices per unit and the total price. If a discrepancy exists 8 between the price per unit and the extended amount of any bid item, the price per unit will 9 control. If a minimum bid amount has been established for any item and the bidder’s unit 10 or lump sum price is less than the minimum specified amount, the Contracting Agency will 11 unilaterally revise the unit or lump sum price, to the minimum specified amount and 12 recalculate the extension. The total of extensions, corrected where necessary, including 13 sales taxes where applicable and such additives and/or alternates as selected by the 14 Contracting Agency, will be used by the Contracting Agency for award purposes and to fix 15 the Awarded Contract Price amount and the amount of the contract bond. 16 17 1-03.1(1).rtf 18 1-03.1(1) Identical Bid Totals 19 (December 30, 2022 APWA GSP) 20 21 Revise this section to read: 22 23 After opening Bids, if two or more lowest responsive Bid totals are exactly equal, then 24 the tie-breaker will be the Bidder with an equal lowest bid, that proposed to use the 25 highest percentage of recycled materials in the Project, per the form submitted with the 26 Bid Proposal. If those percentages are also exactly equal, then the tie-breaker will be 27 determined by drawing as follows: Two or more slips of paper will be marked as follows: 28 one marked “Winner” and the other(s) marked “unsuccessful”. The slips will be folded to 29 make the marking unseen. The slips will be placed inside a box. One authorized 30 representative of each Bidder shall draw a slip from the box. Bidders shall draw in 31 alphabetic order by the name of the firm as registered with the Washington State 32 Department of Licensing. The slips shall be unfolded and the firm with the slip marked 33 “Winner” will be determined to be the successful Bidder and eligible for Award of the 34 Contract. Only those Bidders who submitted a Bid total that is exactly equal to the lowest 35 responsive Bid, and with a proposed recycled materials percentage that is exactly equal 36 to the highest proposed recycled materials amount, are eligible to draw. 37 38 COE 1-03.3.OptionB.RTF 39 1-03.3 Execution of Contract 40 (January 4, 2024 APWA GSP Option B) 41 42 Revise this section to read: 43 44 Within 3 calendar days of Award date (not including Saturdays, Sundays and Holidays), 45 the successful Bidder shall provide the information necessary to execute the Contract to 46 the Contracting Agency. The Bidder shall send the contact information, including the full 47 name, email address, and phone number, for the authorized signer and bonding agent to 48 the Contracting Agency. 49 50 Copies of the Contract Provisions, including the unsigned Form of Contract, will be 51 available for signature by the successful bidder on the first business day following award. 52
