18TH STREET PEDESTRIAN IMPROVEMENTS 3741 RMT July 03, 2024 12 Calculations, surveying, and measuring required for setting and maintaining the 1 necessary lines and grades shall be the Contractor's responsibility. The Contractor 2 shall build the ADA features within the specifications in the Standard Plans and 3 contract documents. 4 5 ADA Feature Contract Compliance 6 The Contractor shall be responsible for completing measurements to verify all ADA 7 features comply with the Contract in the presence of the Engineer. 8 9 ADA Feature As-Built Measurements 10 The Contractor shall be responsible for providing the latitude and longitude of each 11 ADA feature as indicated on the ADA Inspection Form(s) (WSDOT Form 224-020). 12 13 The completed ADA Inspection Form(s) (WSDOT Form 224-020) shall be submitted 14 as a Type 3 Working Drawing and transmitted to the Engineer within 30 calendar 15 days of completing the ADA feature. After acceptance, the Contracting Agency will 16 submit the final form(s) to the WSDOT ADA Steward. 17 18 19 Payment 20 Payment will be made for the following bid item that is included in the Proposal: 21 22 "ADA Features Surveying", lump sum. 23 24 The lump sum Contract price for "ADA Features Surveying" shall be full pay for all the 25 Work as specified. 26 27 In the instance where an ADA feature does not meet accessibility requirements, all work 28 to replace non-compliant work and then to measure, record the as-built measurements, 29 and transmit the electronic forms to the Engineer shall be completed at no additional cost 30 to the Contracting Agency. 31 32 1-05.7.RTF 33 1-05.7 Removal of Defective and Unauthorized Work 34 (October 1, 2005 APWA GSP) 35 36 Supplement this section with the following: 37 38 If the Contractor fails to remedy defective or unauthorized work within the time specified 39 in a written notice from the Engineer, or fails to perform any part of the work required by 40 the Contract Documents, the Engineer may correct and remedy such work as may be 41 identified in the written notice, with Contracting Agency forces or by such other means as 42 the Contracting Agency may deem necessary. 43 44 If the Contractor fails to comply with a written order to remedy what the Engineer 45 determines to be an emergency situation, the Engineer may have the defective and 46 unauthorized work corrected immediately, have the rejected work removed and replaced, 47 or have work the Contractor refuses to perform completed by using Contracting Agency 48 or other forces. An emergency situation is any situation when, in the opinion of the 49 Engineer, a delay in its remedy could be potentially unsafe, or might cause serious risk 50 of loss or damage to the public. 51 52
