18TH STREET PEDESTRIAN IMPROVEMENTS 3741 RMT July 03, 2024 31 F1-08.5.OPT7.FR1.docx 1 (March 13, 1995) 2 This project shall be physically completed within *** 43 *** working days. 3 4 1-08.9.OptionB.RTF 5 1-08.9 Liquidated Damages 6 (March 3, 2021 APWA GSP, Option B) 7 8 Revise the second and third paragraphs to read: 9 10 Accordingly, the Contractor agrees: 11 12 1. To pay (according to the following formula) liquidated damages for each 13 working day beyond the number of working days established for Physical 14 Completion, and 15 16 2. To authorize the Engineer to deduct these liquidated damages from any 17 money due or coming due to the Contractor. 18 19 Liquidated Damages Formula 20 21 LD=0.15C/T 22 23 Where: 24 25 LD = liquidated damages per working day (rounded to the nearest dollar) 26 C = original Contract amount 27 T = original time for Physical Completion 28 29 When the Contract Work has progressed to Substantial Completion as defined in the 30 Contract, the Engineer may determine the Contract Work is Substantially Complete. The 31 Engineer will notify the Contractor in writing of the Substantial Completion Date. For 32 overruns in Contract time occurring after the date so established, the formula for 33 liquidated damages shown above will not apply. For overruns in Contract time occurring 34 after the Substantial Completion Date, liquidated damages shall be assessed on the 35 basis of direct engineering and related costs assignable to the project until the actual 36 Physical Completion Date of all the Contract Work. The Contractor shall complete the 37 remaining Work as promptly as possible.
