8. ADDITIONAL RESTRICTIONS AND DUTILS <br />8.1. Offensive or Unlawful Activities. No noxious or offensive activities shall be carried on <br />upon the Property. No unlawful use shall be made of the Property or any part of it, and all applicable laws, <br />zoning ordinances, health, fire and safety ordinances, regulations, requirements and directives of all <br />governmental authorities having jurisdiction over the Property shall be observed. Development and <br />construction actiN '.ties by Declarant or its affiliates or by or on behalf of the Master Association shall not <br />be considered to violate this Section. <br />8.2. Maintenance of Structures and Grounds Each Owner shall maintain such Owner's Lot, <br />Unit, Improvements and appurtenances thereon in a safe, clean and attractive condition, in a first class <br />nanner, and in such fashion as not to create a fire or other hazard. Such maintenance shall include, without <br />limitation, painting, repair, and replacement of and care for roofs, gutters, downspouts, exterior building <br />surfaces, glass, other building Improvements. Unless provided to the contrary herein, in Sub -Association <br />governing documents or by notice from the Declarant, the Owners are not responsible for maintaining and <br />repairing Common Maintenance Areas (if any) located on the Owner's Lot but the Master Association's <br />cost of same shall be deemed a cost payable by the Lot Ovz ners pursuant to Association assessments. <br />Specific rules on the trimming and cultivation of trees designed to preserve views within the Property may <br />be adopted in the Rules and Regulations. <br />8.3. Vehicles in Disrepair. No Owner or Permitted User shall permit any vehicle that is <br />inoperable, in an extreme state of disrepair or does not have a current operating license to be abandoned or <br />parked upon any Lot or on the Common Area. A vehicle shall be deemed in an "extreme state of disrepair" <br />when the Board reasonably determines that its presence would be offensive to the Permitted Users of the <br />Property. Should any Owner or Permitted User fail to remove such vehicle within twenty-four (24) hours <br />following the date on which notice is mailed or delivered to the owner of the vehicle by the Master <br />Association (including by attachment to the vehicle), the Master Association may have the vehicle removed <br />from the Property and charge the expense of such removal and storage to the owner of the vehicle. <br />8.4. Signs. No signs shall be erected or maintained on any Lot or the exterior of any building(s) <br />or Improvements located thereon except signs that comply with the Comprehensive Signage Plan dated <br />as approved by the City of Everett In all events, signs must comply with applicable law. Signs <br />erected or maintained by Declarant or its affiliates, agents employees or contractors, or by or onbehalf of <br />the Master Association shall not be considered to violate this Section. <br />8.5. Rubbish and Trash. No Lot, Unit, or part of the Common Area shall be used as dumping <br />ground for trash or rubbish of any kind. All garbage and the other debris and waste shall be kept in <br />appropriate closed sanitary containers for proper disposal. All outdoor refuse collection areas shall be <br />visually screened to the reasonable satisfaction of the Board so as to minimize visibility from neighboring <br />properties or streets. No refuse collection area shall be permitted between the street and the front of any <br />building. The containers and all grounds shall be maintained in a manner that will not attract or aid in the <br />propagation of insects or venn.n or create a health hazard. No Hazardous Substances shall be disposed of <br />in any manner m the refuse collection area. Hazardous Substances that are to be removed from a Lot for <br />reprocessing or disposal off site may be stored on the Lot for reasonable periods not exceeding sixty (60) <br />days while removal is being arranged, however, those Hazardous Substances must be stored in <br />appropriately designed and marked containers within enclosed buildings and in strict accordance with all <br />applicable Environmental Laws The storage of materials related to Declarants or the Master Association's <br />development or construction activities shall not be deemed to v olate this Section 8.5.
