shall be addressed to any person at the address given by such person to the Master Association for the <br />purpose of service of such notice, of to the residence of such person (or, in the case of an entity, the <br />registered agent for such entity) if no address has been given to the Master Association. Such address may <br />be changed from time to time by notice in writing to the Master Association. <br />14.6. Right of Enforcement Except as otherwise provided herein, any Member covered by this <br />Master Declaration shall have the right to enforce any or all of the provisions hereof against any property <br />covered by this Master Declaration, the Owners thereof, the Master Association, and the Members. The <br />provisions of this Master Declaration referencing a Mortgagee or giving a Mortgagee specific rights shall <br />be enforceable by any such Mortgagee and any such Mortgagee shall be a third -party beneficiary with <br />respect to all such provisions of this Master Declaration. <br />14.7. No Fiduciary Standard. In no event shall Declarant or any of Declarant's agents, <br />employees, officers, aff Bates or contractors be deemed to be a fiduciary of the Owners, any sub -association <br />or member thereof or be held to a fiduciary standard with respect to activities hereunder. <br />14.8. Remedies Cumulative. Each remedy provided herein is cumulative and not exclusive. <br />14.9 Joint Owners. In any case in which two or more persons share the ownership of any Lot <br />or Unit, regardless of the form of ownership, the responsibility of such persons to comply with this Master <br />Declaration shall be a joint and several responsibility and the act or consent of any one or more of such <br />persons shall constitute the act or consent of the entire ownership interest. <br />14.10. Non -Waiver. The failure to enforce any of the provisions herein at any time shall not <br />constitute a waiver of the rights to enforce any such provision or any other provision of said restrictions. <br />14.11. No Partition. There shall be no Judicial partition of the Common Area. No person or entity <br />shall seek any judicial partition unless the Property or such portion thereof have been removed from the <br />provisions of this Master Declaration. <br />14.12. Security. The Master Association shall have no responsibility for safety and security <br />matters within the Property, although the Master Association may, in its sole discretion, elect to provide <br />security services for the Property. Neither the Master Association nor Declarant shall in any way be <br />considei ed insurers or guarantors of security for the Property nor shall an} of them be held liable for any <br />loss or damage by reason of failure to provide adequate security or of ineffectiveness of security measures <br />undertaken. No representation or warranty is made that any security measures cannot be compromised or <br />circumvented, nor than any such security measures undertaken will in all cases prevent loss or provide the <br />protection for which the measures are intended. Each owner acknowledges and understands that the Master <br />Association, its Board of Directors and committees, and Declarant are not insurers and that each person <br />using the Property assumes all risks for loss or damage to persons, Lots, Units, and the contents of Units <br />resulting from acts of third parties. <br />14.13. Indexing. Whenever any dollar amount is specified in these Bylaws, such amount shall be <br />automatically adjusted each January 1 based upon any changes in the Consumer Price Index All Items — <br />for all urban consumers published by the U.S. Bureau of Labor Statistics (or any generally accepted <br />substitute for such index, if such index shall be discontinued) using the index for December, 20 , as the <br />base year. <br />27 <br />4864-8276-8240, v. 14 <br />
