FAILURE TO COMPLY: Per EMC 1.20.120(C), if any of the work is not commenced or completed within the <br />time specified for compliance or any assessed penalty, fee or cost is not paid by the specified due date, <br />the City may proceed to abate the violation, cause work to he done, and assess the costs and expenses <br />of abatement incurred by the City against the person responsible, including the vacating the Property <br />and boarding up the structures on the Property. Additionally, the City may take any other legal action, <br />including liening the Property for the costs of the abatement and any unpaid fines or penalties. Further, <br />failure to correct the violations cited in this Notice may lead to the suspension, revocation, modification, <br />and/or denial of current or subsequent City of Everett permit applications on the Property. <br />TRANSFER OF OWNERSHIP: It is unlawful to sell, transfer, mortgage, lease, or dispose of the Property unless <br />the property owner has complied with EMC 1.20.090. <br />RIGHT TO APPEAL: Any person named in the Notice and Order or having any record or equitable title in the <br />property against which the Notice and Order is recorded may appeal the Notice and Order to the <br />hearing examiner within 14 days of the date of service of the Notice and Order The procedures for <br />exercising your appeal rights are attached to this Notice and Order and are listed in EMC 1.20.250-260. <br />FAILURE TO APPEAL: A failure to appeal the Notice and Order within the applicable time limits renders the <br />Notice and Order a final determination that the conditions described in the Notice and Order existed <br />and constituted a civil code violation, and that the named party is liable as a person responsible for the <br />code violation. (EMC 1.20.260 (C)) <br />OBLIGATION TO NOTIFY The Responsible Person(s) has the affirmative duty to notify the City of any actions <br />taken to achieve compliance with this Notice.
