1PMC 108.1.4 Unlawful structure. An unlawful structure is one found in whole or in part to be occupied <br />by more persons than permitted under this code, or was erected, altered or occupied contrary to law. <br />1PMC 106.1 Unlawful acts. <br />It shall be unlawful for a person, firm or corporation to be in conflict with or in violation of any of the <br />provisions of this code. <br />1PMC 108.1.1, Unsafe structures. An unsafe structure is one that is found to be dangerous to the life, <br />health, property or safety of the public or the occupants of the structure by not providing minimum <br />safeguards to protect or warn occupants in the event of fire, or because such structure contains unsafe <br />equipment or is so damaged, decayed, dilapidated, structurally unsafe or of such faulty construction or <br />unstable foundation, that partial or complete collapse is possible. <br />CORRECTIVE ACTIONS REQUIRED: By the stated dates, the Responsible Person(s) shall take the following <br />actions to correct the Code Violations at the Property: <br />m <br />0 <br />Property was CONDEMNED on January 31, 2024, and must remain vacant until occupancy is <br />granted by the Building Division. <br />Contact the City of Everett Permit Services Division located at 3200 Cedar Street to submit <br />complete permit applications for all the necessary and required permits to bring the property <br />into compliance. Information on the City of Everett permit application process and required <br />documents can be found at www.everettwa.gov/permits. <br />Corrective Action Due Date: 3/4/2024 <br />O Once permits are issued, then, correct and complete all of the deficiencies that are present <br />within the structure and have the work inspected and approved, by the Everett City Building <br />Division. <br />Corrective Action Due Date: 6/3/2024 <br />Note that all required permits (if applicable) to perform the corrective action must be obtained from the <br />proper issuing agency. <br />CIVIL PENALTIES: If the corrective action is not completed by the date set for compliance, a monetary <br />penalty in the amount of $250 shall accrue for each day or portion thereof that each violation continues <br />beyond the date for compliance set in this Notice and Order, until compliance with the Notice and Order <br />is achieved. (EMC 1.20.190) <br />IMPORTANT NOTE: PAYMENT OF THE MONETARY PENALTY DOES NOT RELIEVE THE VIOLATOR OF THE <br />DUTY TO CORRECT, ABATE OR STOP THE CODE VIOLATIONS AND/OR PAY ANY AND ALL OTHER COST <br />ASSESSED. <br />COST OF ENFORCEMENT: Per EMC 1 20.180, the City is authorized to recovery any and all costs of <br />enforcement related to ensuring the Property is brought into compliance. <br />RECORDING: This Notice and Order may be recorded with the Snohomish County Assessor's Office, <br />subsequent to service of the Notice on the responsible person(s).
