This TRANSMISSION LINE CONNECTION RE-ROUTE AND WATER SERVICE <br />COVENANT AND AGREEMENT (this "Covenant'), dated for reference purposes as of <br />2024, and is entered into by and between XIAOJUN YAN AND <br />XIAOYI NG CHEN (the "Grantor" or the "Customer"), and the CITY OF EVERETT, a <br />Washington municipal corporation (the "City' or "Grantee). Grantor Is owner of certain <br />property legally described in attached Exhibit A to this Covenant and referred to in this <br />Covenant as the "Property." As described in Exhibit Athe Property consists of two <br />parcels, which are referred to in this Covenant as "Parcell" (which is Snohomish County <br />Parcel No. 28050400101100) and "Parcet2" (which is Snohomish County Parcel No. <br />28050400101300). <br />RECITALS <br />Snohomish County's regional water supply is dependent on continued operation <br />and maintenance of the City's water transmission lines. In limited circumstances, the City <br />will allow the re-routing of an existing customer connected to a water transmission line <br />from an existing connection point to a replacement connection point. In the case of the <br />undersigned Grantor, the Public Works Director has determined to accommodate the <br />Grantors re-route request and provide Grantor a replacement connection to the City's <br />transmission line (the "Replacement Transmission Line Connection"), subject to the <br />provisions of this Covenant. <br />COVENANT AND AGREEMENT <br />In consideration of the mutual promises set forth herein, and for other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, <br />Grantor hereby covenants, grants, and agrees as follows: <br />1. Grantor Obligations and Requirements. The Grantor agrees to the <br />following, which will govern the Replacement Transmission Line Connection and will <br />supplement the requirements of the Everett Municipal Code: <br />a. Replacement TLine Connection Installation / Water <br />Meter. The City will complete the work as necessary to establish the Replacement <br />Transmission Line Connection at Grantors cost. The City will install a water meter for <br />the Replacement Transmission Une Connection at the Grantors cost. The City will <br />require prepayment of the City's estimates of such costs. Once the Replacement <br />Transmission Une Connection is put in service, the Grantor is no longer allowed to <br />receive water from the Grantor's previous connection(s) to the Hoang Water System. <br />b. Service Une(s). The Grantor is responsible for installation of <br />service line to the water meter at Grantors cost. Any connection to the water meter will <br />be completed by the City and not by Grantor. The Grantor is responsible for obtaining <br />Covenant and Agreement)or Re-goute and WarerServke Pavel <br />
