WHEREAS, to initiate the accomplishment of these goals and through this ordinance, <br /> $4,500,000 will be transferred to CIP 5 from the unrestricted and undesignated funds of Fund <br /> 162, Capital Improvements Reserve (CIP 4); <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: There is hereby created a special Program entitled the "Parks and Recreational <br /> Improvements Program 005 of 1999 (i.e., CIP 5)" which is designated a reserve account for <br /> parks and recreational purposes. Appropriations from the Parks and Recreational <br /> Improvements Fund of 1999 shall be made only by the City Council for planning, purchase, <br /> design and construction of parks and recreational projects; to match funds raised by the Everett <br /> Parks Foundation, other entities, other private contributors, or other grant sources; and for <br /> other parks and recreation purposes. <br /> SECTION 2: Appropriations from CIP 5 are intended to complement and augment <br /> appropriations from the Community and Recreational Improvements Fund of 1988. Expenses <br /> may include, but not be limited to, all necessary design and construction expenses. The <br /> Administration shall plan for and define specific parks and recreation projects to be reviewed <br /> and approved by Council. Upon the effective date of this ordinance, four and one-half million <br /> Dollars ($4,500,000) shall be transferred from Fund 162, Program 004 to Fund 162, Program <br /> 005. <br /> SECTION 3: The City Council finds that the purchase of the Simpson Property and the <br /> Glacier Park Property met the original intent of CIP 1. The City Council reaffirms its intent <br /> for high quality mixed-use redevelopment of the Snohomish Riverfront; including but not <br /> limited to the Simpson Property and the Glacier Park Property, expressed in the 1987 <br /> Pedestrian and Bicycle Access Plan for Everett's Snohomish Riverfront and the 1994 <br /> Comprehensive Plan vision for the Snohomish Riverfront south of the Highway 2 bridge. <br /> SECTION 4: Ordinance No 1420-87 is hereby amended to add a new section, that being: <br /> Nothing contained herein shall limit or restrict the uses and disposition of any real property <br /> purchased with funds authorized under Ordinance No. 1420-87 or the disposition of any <br /> proceeds from such real property. <br /> SECTION 5: Should any section, subsection, paragraph, sentence, clause or phrase of this <br /> ordinance or its application to any person or situation be declared unconstitutional or invalid <br /> for any reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation.
