WHEREAS, several residents recently have alleged that language in Ordinance No. 1420-87 <br /> requires the Glacier Park and Simpson properties to be used exclusively for parks and <br /> recreation purposes; and <br /> WHEREAS, the City Attorney's Office respectfully disagrees with such interpretations of <br /> Ordinance No. 1420-87; and <br /> WHEREAS, CIP 1 did not expressly require all funds be used exclusively for parks and <br /> recreation projects, although some citizens may believe to the contrary; and further, such <br /> citizens believe the $4,500,000 used to purchase the Simpson Property and the Glacier Park <br /> Property should be used only for parks and recreation purposes; and <br /> WHEREAS, the City Council wishes to address the concerns of citizens believing the <br /> $4,500,000 of CIP 1 funds should be restricted to parks and recreation purposes, and, thus, is <br /> willing to transfer $4,500,000 of unrestricted general fund capital facility reserve funds in CIP <br /> 4 to a new reserve fund, CIP 5, which will be for the exclusive use for parks and recreation <br /> purposes; and <br /> WHEREAS, the City Council wishes to restate its intentions since 1987 concerning attractive <br /> and high quality redevelopment which includes multiple uses of the properties along the <br /> Snohomish River and, further, to amend Ordinance 1420-87 to eliminate any confusion which <br /> may exist and make clear there are no limitations on the use or disposition of the Simpson <br /> Property and the Glacier Park Property resulting from the use of CIP 1 funds to purchase these <br /> properties; and <br /> WHEREAS, the original CIP 1 Capital Improvements Fund 150 was deemed to have <br /> accomplished its intended and designated purposes and having met its limits of 5 years duration <br /> and $30,000,000 total spending cap, it was closed and consolidated into Fund 162, Capital <br /> Improvements Reserve; and <br /> WHEREAS, the City Council further finds that the need for improvements is documented by <br /> the 1999 Everett Parks Comprehensive Plan which includes softball, baseball and soccer fields, <br /> neighborhood parks, the acquisition of additional park lands and the improvement of existing <br /> and new parks; and <br /> WHEREAS, the City Council finds that it is in the best interests of the City of Everett to <br /> establish the Parks and Recreational Improvements Program 005 as a new Reserve Account <br /> exclusively for Parks and Recreational Improvements (CIP 5); and <br /> 6 <br />
