E. Notwithstanding the other provisions provided in this chapter, anything done contrary to <br /> the provisions of this chapter of the failure to comply with the provision of this chapter is declared <br /> to be a public nuisance. <br /> F. The city is authorized to apply to any court of competent jurisdiction for and such court, <br /> upon hearing and for cause shown, may grant a preliminary, temporary or permanent injunction <br /> restraining any person, firm, and/or corporation from violating any of the provisions of this <br /> chapter and compelling compliance with the provisions thereof and the violator shall pay all city <br /> costs of seeking such injunction in the event the city is successful in obtaining the injunction. <br /> Section 11: Section 5 of Ordinance 534-78, as amended by section 2 of Ordinance 690-80 and <br /> section 1 of Ordinance 1971-93 (EMC 20.08.090), which reads as follows: <br /> Public nuisance and disturbance noises. <br /> A. Public Nuisance Noises. Pursuant to Section 20.08.200 of this chapter, the administrator <br /> may determine that a sound constitutes a public nuisance noise as defined herein. It is unlawful for <br /> any person to cause or allow to be emitted a noise which has been determined a public nuisance <br /> noise. <br /> B. Public Disturbance Noises. It is unlawful for any person to cause, or for any person in <br /> possession of property to allow to originate from the property, sound that is a public disturbance. <br /> No sound source specifically exempted from a maximum permissible sound level by this chapter <br /> shall be a public nuisance noise or public disturbance noise insofar as the particular source is <br /> exempted. The following sources of sound shall be public disturbance noises and are also subject <br /> to regulation under the provisions of Sections 20.08.030 through 20.08.050: <br /> 1. Frequent, repetitive or continuous noise made by any animal which unreasonably <br /> disturbs or interferes with the peace, comfort and repose of property owners or possessors, <br /> except that such sounds made in animal shelters, or commercial kennels, veterinary hospitals, pet <br /> shops or pet kennels licensed under and in compliance with Chapter 6.04 shall be exempt from <br /> this subsection; provided, that notwithstanding any other provision of this chapter, if the owner or <br /> other person having custody of the animal cannot, with reasonable inquiry, be located by the <br /> investigating officer or if the animal is a repeated violator of this subsection, the animal shall be <br /> impounded by the poundmaster, subject to redemption in the manner provided by Section <br /> 6.04.070; <br /> 2. The frequent, repetitive or continuous sounding of any horn or siren attached to a <br /> motor vehicle, except as a warning of danger or as specifically permitted or required by law; <br /> 3. The creation of frequent, repetitive or continuous noise in connection with the <br /> starting, operation, repair, rebuilding or testing of any motor vehicle, motorcycle, off-highway <br /> vehicle or internal combustion engine within District I so as to unreasonably disturb or interfere <br /> with the peace, comfort and repose of owners or possessors of real property; <br /> 4. Yelling, shouting, hooting, whistling or singing on or near the public streets, <br /> particularly between the hours of eleven p.m. and seven a.m. or at any time and place so as to <br /> unreasonably disturb or interfere with the peace, comfort and repose of owners or possessors of <br /> real property; <br /> 25 <br />
