<br />Unreasonable Delays. Extensions of Job Order Completion Time, if any, will be determined by the <br />Project Manager. Time extensions will be allowed only to the extent that completion of the Work <br />is unreasonably delayed through no fault of the Contractor, which must in all cases unless <br />otherwise determined by the Project Manager be substantiated by impact to the critical path on <br />the Progress Schedule. Any extension of the Job Order Completion Time by the City will be set <br />forth in writing, which shall specify the calendar days by which the Contract Time is to be <br />increased. <br />No extension of time shall be allowed for any claimed delay which is caused by or results from <br />concurrent delay or the fault, negligence, or collusion of the Contractor or its Subcontractors, <br />suppliers, or any others, or any of their acts or failure to act or to timely perform the Work <br />according to the Contract. Failure to make timely submittals to the City, procure materials or <br />workmen, or perform the Work in accordance with the requirements of the Detailed Scope of Work, <br />or to adequately plan for such functions will not be an adequate reason for an extension of the Job <br />Order Completion Time. <br />In no event shall the Contractor be entitled to loss or damage, including a change in Job Order Price <br />for any delay in the Contractor’s prosecution of the Work, even if such delay is caused by the City, <br />except to the extent such acts or omissions of the City result in a delay to the Project’s critical path, <br />in which case the Contractor may receive an adjustment to the Job Order Price and/or an extension <br />of the Job Order Completion Time. Any request for such cost shall be established and documented <br />by the Contractor in detail to the satisfaction of the Project Manager. If the Contractor fails to fully <br />comply with section 6.30, its claim for an extension of the Job Order Completion Time or <br />adjustment to the Job Order Price on account of such claimed delay is waived. <br />The Job Order Completion Time may only be changed by the City. Any request for an extension in <br />the Job Order Completion Time shall be based on written notice delivered to the Project Manager <br />and Contract Administrator within fifteen (15) days of the occurrence of the event giving rise to the <br />request. All requests for adjustment in the Job Order Completion Time shall be determined by <br />Contract Administrator if Project Manager and Contractor cannot otherwise agree. Any change in <br />the Job Order Completion Time resulting from any such request shall be incorporated in a Field <br />Order. <br />The Job Order Completion Time will be extended in an amount equal to time lost due to delays <br />beyond the control of Contractor if a request is made therefore as provided in this Article 10. <br />All time limits stated in the Job Orders and the Contract Documents are of the essence of the <br />Contract. The provisions of this Article 10 shall not exclude recovery for damages including <br />compensation for additional professional services for delay by either party. <br /> <br />END ARTICLE 10
