<br />c. the Job Order Price has been reduced because of Supplemental Job Order(s); <br />d. City has been required to correct defective Work or complete the Work in accordance <br />with section 11.7; <br />e. of Contractor's unsatisfactory prosecution of the Work in accordance with the <br />Detailed Scope of Work; <br />f. Contractor's failure to make payment to Subcontractor, or for labor, materials or <br />equipment; or, <br />g. of quantity adjustment or correction. <br />12.4 Substantial Completion <br />12.4.1 When Contractor considers the entire Work ready for its intended use Contractor will certify <br />in writing to Project Manager that the entire Work is substantially complete and request <br />that Project Manager issue a Certificate of Substantial Completion. Within a reasonable <br />time thereafter, Contractor and Project Manager will make an inspection of the Work to <br />determine the status of completion. If Project Manager does not consider the Work <br />substantially complete, Project Manager will notify Contractor in writing giving his/her <br />reasons. If Project Manager considers the Work substantially complete, Project Manager <br />will prepare a Certificate of Substantial Completion which shall fix the date of Substantial <br />Completion. There shall be attached to the certificate a tentative “punch list” of items to be <br />completed or corrected before final payment. A copy of the Certificate of Substantial <br />Completion shall be forwarded to the Contract Administrator. <br />12.4.2 City has the right to exclude Contractor from the Work after the date of Substantial <br />Completion, but will allow Contractor reasonable access to complete or correct items on <br />the punch list. <br />12.5 Partial Utilization <br />Use by City of completed portions of the Work may be accomplished prior to Substantial <br />Completion of all the Work subject to the following: <br />a. City at any time may request in writing to Contractor to permit City to use any part of the Work <br />which is believed to be substantially complete and can be used without significant interference <br />with the other parts of the Work. If Contractor agrees, Contractor will certify to City and <br />Project Manager that said part of the Work is substantially complete and request Project <br />Manager to issue a Certificate of Substantial Completion for that part of the Work. Within a <br />reasonable time City, Contractor and Project Manager will make an inspection of that part of <br />the Work to determine its status of completion. If Project Manager does not consider that part <br />of the Work to be substantially complete, Project Manager will notify Contractor in writing <br />giving his/her reasons. If Project Manager considers that part of the Work to be substantially <br />complete, Project Manager will execute and deliver to Contractor a certificate to that effect, <br />fixing the date of Substantial Completion as to that part of the Work, attaching a tentative list <br />(punch list) of items to be completed or corrected before final payment. City will have the right <br />to exclude Contractor from any part of the Work which Project Manager has so certified to
