ARTICLE 15 MISCELLANEOUS <br />15.1 General Requirements <br />15.1.1 Should City or Contractor suffer injury or damage to its person or property because of any <br />error, omission or act of the other party or of any of the other party's employees or agents <br />or others for whose acts the other party is legally liable, claim shall be made in writing to <br />the other party within a reasonable time of the first observance of such injury or damage. <br />15.1.2 The duties and obligations imposed by these General Conditions and the rights and remedies <br />available hereunder to the parties hereto, and, in particular but without limitation, the <br />warranties, guarantees and obligations imposed upon Contractor by sections 11.1, and 13.2 <br />and all of the rights and remedies available to City thereunder, shall be in addition to, and <br />shall not be construed in any way as a limitation of, any rights and remedies available to any <br />or all of them which are otherwise imposed or available by law or contract, by special <br />warranty or guarantee or by other provisions of the Contract Documents, and the provisions <br />of this section shall be as effective as if repeated specifically in the Contract Documents in <br />connection with each particular duty, obligation, right and remedy to which they apply. All <br />representations, warranties and guarantees made in the Contract Documents shall survive <br />final payment and termination or completion of this Contract. <br />15.2 Giving Notice <br />Whenever any provision of the Contract Documents requires the giving of written notice it shall <br />be deemed to have been validly given if delivered in person to the individual or to a member of <br />the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by <br />registered or certified mail, postage prepaid, to the last business address known to the giver of <br />the notice. <br />15.3 Computation of Time <br />When any period of time is referred to in the Contract Documents by days, it shall be computed to <br />exclude the first and include the last day of such period. If the last day of any such period falls on <br />a Saturday or Sunday or on a day made a legal holiday by the law of the applicable jurisdiction, <br />such day shall be omitted from the computation. <br />15.5 Non-Discrimination <br />Contractor shall not discriminate on the grounds of race, color, sex or national origin in the <br />selection and retention of Subcontractors, including procurement of materials and leases of <br />equipment. Contractor shall not participate either directly or indirectly in such discrimination, <br />including discrimination in employment practices. In the event of Contractor’s noncompliance with <br />the nondiscrimination provisions of the Contract Documents or applicable law, City may impose <br />such sanctions as it, or the City’s funding agencies, may determine to be appropriate, including, <br />but not limited to: (a) withholding of payments to Contractor until Contractor complies, and (b) <br />termination or suspension of the Contract, in whole or in part. <br />END ARTICLE 15
