<br />ARTICLE 19 COMPLIANCE WITH THE JOC RCW REQUIREMENTS <br />19.1 CONTRACTOR’S RESPONSIBILITY <br />The contractor acknowledges that it has carefully examined the RFP documents and <br />the Job Order Contracting RCWs. For example, the Contract is subject to RCW <br />39.10.200, 39.10.210, 39.10.420, 39.10.430, 39.10.440, 39.10.450, 39.10.460, and <br />39.10.470. <br />19.2 MAXIMUM JOB ORDER VALUE/APPRENTICE UTILIZATION <br />The maximum dollar amount for an individual Job Order is five hundred thousand dollars <br />($500,000) pretax, as may be adjusted by amendments to statute. All Job Orders for the <br />same project (original plus any Supplemental Job Orders) shall be treated as a single Job <br />Order for the purpose of the dollar limit on Job Orders. <br />Unless otherwise allowed by statute, a Job Order issued for a particular project may not <br />exceed $500,000 excluding sales tax and Gordian fees. As required by RCW 39.10.450(3), <br />no more than twenty percent of the dollar value of a Job Order may consist of items of <br />work not contained in the unit price book. As required by RCW 39.10.450(4), any new <br />stand-alone permanent structure constructed under a Job Order shall not exceed three <br />thousand gross square feet. <br />Any Job Order over three hundred fifty thousand dollars ($350,000), excluding Washington <br />state sales and use tax, and including over six hundred single trade hours shall utilize a <br />state registered apprenticeship program for that single trade in accordance with RCW <br />39.04.320. The City may adjust this requirement for a specific Job Order for the following <br />reasons: <br />(a) The demonstrated lack of availability of apprentices in specific geographic <br />areas; <br />(b) A disproportionately high ratio of material costs to labor hours, which does not <br />make feasible the required minimum levels of apprentice participation; <br />(c) Participating contractors have demonstrated a good faith effort to comply with <br />the requirements of RCW 39.04.300 and 39.04.310; or <br />(d) Other criteria the awarding entity deems appropriate. <br />19.3 ADJUSTMENT FACTORS AND CONSTRUCTION TASK CATALOG® <br />The Contractor is paid for the Job Order based upon a fixed percentage multiplier <br />(Adjustment Factor) and fixed prices based on The Gordian Group’s Construction Task <br />Catalog® agreed to in the initial contract. Everything that is to be included in the <br />Contractor’s Adjustment Factors is listed and identified in the Construction Task Catalog® <br />under Construction Task Catalog® Section and “Using the Construction Task Catalog®,” <br />pages 00-1 through 00-7. <br />
