The siding shall be erected as near the center of the street as is reasonably prae.. ticable and the Company shall pave between its rails and on 1 one foot (1) on each side of the rails there of with the same 2 kind of paving as thecity paves said Summit Avenue, andthe 31 paving between the rails and one (1) foot each side thereof, 4 ' shall be on a level with the grade of the street , and providing 5 ' further that the Company shall pave all such portionsof 6 street intersections on S ummit Avenue lu¢ati between averett 7 Avenue and Twenty third Street as shall be occupied by the 8 ' tracks of the Company and on one (1) foot each side of said 9 tracks and the Company shall fill in between the rails to a 10 level with the street between all street intersections from 11 Averett Avenueto Twenty-third S treet and at any time after 12 but not before the expiration of five ( 5) years from the date of 13 the acceptance of this Ordinance the city shall have the right 14 15 to require the Company and the Company shall, when so required, 16 pave its tracks between therails and one foot (1) on each side of the rails on summit Avenue between Everett Avenue and Twenty. 17 third Street, between street intersections with the same kind 18 19 of paving as provided by Ordinance No.130 of theCity of Everett 20 and passed June,18,1894, and acceptance filed with the City 21 Clerk on July,11,1894; the company to pay for said paving.., 22 3 ection 4 : This Ordinance shall be void unless the 23 Company within thirty days ( 30) after its passage shall file 24 its written acceptance with the City Clerk of the City of 25 Everett, subjecg to the terms and conditions set forth in 26 this Ordinance , Passed: W H _�� Mayor.
