<br />ARTICLE 2 PRELIMINARY MATTERS <br />2.1 City Operations <br />The City is an operating facility that will continue in full operation throughout the term of this <br />contract. Where facility operations conflict with those of the Contractor, the operations of the <br />facility will take precedence over those of the Contractor. It shall be the sole responsibility of the <br />Contractor to schedule and coordinate its activities with those of the facility to ensure minimum <br />disruption of facility operations. <br />2.2 Starting the Job Order (Notice to Proceed) <br />The Contractor shall show evidence that work has commenced on the Job Order within seven (7) <br />days from the effective date of the Notice to Proceed. Work, in this case, is not limited to physical <br />work at the project site. Work started prior to the effective date stated in the Notice to Proceed <br />shall be at the Contractor's risk. <br />2.3 Job Order Completion Time <br />2.3.1 The Job Order Completion Time will commence to run on the effective date stated in the <br />Notice to Proceed. The City Contract Administrator will transmit an executed copy of the <br />Job Order to the Contractor as well as a Notice to Proceed. <br />2.3.2 The Job Order Completion Time is that period of time allotted in the Job Order, as <br />adjusted, for Contractor to achieve Substantial and/or Final Completion of the Detailed <br />Scope of Work. <br />2.3.3 The term “day” as used in the Contract Documents shall mean a calendar day unless <br />otherwise specifically designated. <br />2.3.4 Substantial Completion occurs when the City can use the Work for the use for which it is <br />intended, and when all required documentation has been properly submitted to the City in <br />accordance with the Job Order. Such documentation shall include but is not necessarily <br />limited to: <br />a. Maintenance and Operations manuals; <br />b. Warranties; and <br />c. Submittals required by the Specifications <br />2.3.5 Final Completion occurs when all requirements of the Job Order and Contract Documents <br />have been properly and completely fulfilled including but not limited to: <br />a. Completion of re-inspection and City approval of all Punch List items; <br />b. Submittal of final invoice and approval by the Contract Administrator and <br />Project Manager; <br />c. Submittal of all properly completed as-built record drawings; and <br />d. Submittal of any other documents required by the Job Order.
