<br />ARTICLE 6 CONTRACTOR'S RESPONSIBILITIES
<br />6.1 Examination of the Site of Work and Detailed Scope of Work
<br />6.1.1 By submitting a Job Order Proposal for a Job Order, the Contractor represents that it has
<br />carefully examined and investigated the site(s) of the Work, including material site(s), and
<br />Detailed Scope of Work. The submission of its Job Order Proposal shall be conclusive evidence
<br />that the Contractor represents and acknowledges that it has made such examinations and
<br />investigations and is satisfied as to the conditions to be encountered in the performance of the
<br />Work, including the character, quantity, quality, and Detailed Scope of the Work, safety
<br />precautions to be undertaken, the quantities and qualities of materials to be supplied, and
<br />equipment and labor to be used, the requirements of the Detailed Scope of Work and how all
<br />such requirements correlate to the conditions at the site(s) of the Work.
<br />6.1.2 The Contractor shall determine from careful examination of the Detailed Scope of Work and
<br />the site of the Work, the methods, materials, labor, and equipment required to perform the
<br />Work in full, and the Contractor shall reflect the same in its Proposal.
<br />6.2 Error, Inconsistency, Omission or Variance in the Contract Documents
<br />6.2.1 The Contractor shall promptly report to the Project Manager and/or the Contract
<br />Administrator any error, inconsistency, omission, or variance from applicable laws, statutes,
<br />codes, ordinances, or regulations which it discovers in the Detailed Scope of Work. If the
<br />Contractor promptly reports such discovery prior to commencement of any portion of the
<br />Work affected by any such error, inconsistency, omission, or variance, the Contractor shall
<br />not be liable to the City for damage resulting from such error, inconsistency, omission, or
<br />variance. If, however, the Contractor fails either to carefully study and compare the Detailed
<br />Scope of Work, or to promptly report the discovery of any error, inconsistency omission, or
<br />variance known or believed by the Contractor to exist, the Contractor shall assume full
<br />responsibility therefore and shall bear all costs, liabilities and damages attributable to such
<br />error, inconsistency, omission, or variance.
<br />6.3 Supervision
<br />6.3.1 Contractor shall supervise and direct the Work competently and efficiently, devoting
<br />such attention thereto and applying such skills and expertise as may be necessary to
<br />perform the Work in accordance with the Detailed Scope of Work. Contractor shall
<br />be solely responsible for the means, methods, techniques, sequences and
<br />procedures of Work. Contractor shall be responsible to see that the finished Work
<br />complies accurately with the Detailed Scope of Work.
<br />6.3.2 Contractor will provide a competent resident supervisor who understands the
<br />contract and the task being performed to continuously oversee the contract work.
<br />Supervisor will not be replaced without written notice to Project Manager except
<br />under extraordinary circumstances. The supervisor will be Contractor's
<br />representative at the site and shall have authority to act on behalf of Contractor. All
<br />communications given to the supervisor shall be as binding as if given to Contractor.
<br />a. Any supervisor who repeatedly fails to follow the Project Manager’s written or
<br />oral orders, directions, instructions, determinations or has proven to be
<br />incompetent, careless or negligent shall be subject to removal from the work
