Upon the written request of the Project Manager or Contract <br />Administrator, the Contractor shall immediately remove such supervisor and <br />name a replacement in writing. <br />6.3.3 Contractor shall provide competent, suitably qualified personnel to survey and lay <br />out the Work and perform Work as required by the Detailed Scope of Work. <br />Contractor shall at all times maintain good discipline and order at the site. <br />6.3.4 Non-compliance with the Project Manager’s request to remove and replace personnel <br />at any level shall be grounds for terminating the Contract under the terms of Article <br />13. <br />6.3.5 The Contractor shall be fully responsible to the City for the acts or omissions of its <br />employees, agents, Subcontractors, Sub-Subcontractors, suppliers, and their agents <br />and employees, and all other persons who are to perform any of the Work. <br />6.3.6 The Contractor may not assign any portion of this Contract without the City’s <br />prior written consent. <br />6.4 Labor, Materials, and Equipment <br />6.4.1 Contractor shall furnish all materials, equipment, labor, transportation, equipment <br />and machinery, tools, appliances, fuel, power, light, heat, telephone, water and <br />sanitary facilities and all other facilities and incidentals necessary for the execution, <br />testing, initial operation and completion of the Work. <br />6.4.2 All materials and equipment shall be of good quality and new, except as otherwise <br />provided in the Detailed Scope of Work. If required by Project Manager, <br />Contractor shall furnish satisfactory evidence (including reports or required tests) <br />as to the kind and quality of materials and equipment. <br />6.4.3 All materials and equipment shall be applied, installed, connected, erected, used, <br />cleaned and conditioned in accordance with the instructions of the applicable <br />manufacturer, fabricator, supplier or distributor, except as otherwise provided in <br />the Contract Documents. <br />6.4.4 For equipment and materials that are permanently incorporated in the Work, <br />the Contractor will provide to the Project Manager all Owners Manuals and <br />Operating Instructions furnished by the equipment or material manufacturer. <br />6.5 Equivalent Materials and Equipment, "or Equal" <br />6.5.1 Whenever materials or equipment are specified or described in the Detailed Scope of <br />Work, Drawings, Construction Task Catalog® or Specifications by using the name of a <br />proprietary item or the name of a particular manufacturer, fabricator, supplier or <br />distributor, the naming of the item is intended to establish the type, function, and <br />quality required. Unless the name is followed by words indicating that no substitution <br />is permitted, materials or equipment of other manufacturers, fabricators, suppliers or <br />distributors may be accepted by Project Manager if sufficient information is <br />submitted by Contractor to allow Project Manager to determine that the material or
