1 2 erected as near the center of the street as is reasonably practicable 3 and the Company shall pave between its rails and on one foot (1') 4 on each side of the rails thereof with the same kind of paving as 5 the city paves said Summit Avenue and the paving between the rails 6 and on ose (1 ') foot each side thereon shall be on a level with 7 the grade of the street and providing further that the company 8 shall pave all such portions of street intersections on Summit 9 A.genue between Everett Avenue and Twenty-third Street as shall be 10 occupied by the tracks of the Company and on one (1') foot each 11 side of said tracks and the Company shall fill in between the rails 12 to a level with the street between all street intersections from 13 Everett Avenue to `wenty..third Street and at any time after, but 14 not before the expiration of five (5) years from the date of the acc- 15 eptance of this Ordinance the city shall have the right to require 16 the company and the company shall, when so required, pave its tracks 17 between the rails and one foot (1') on each side of the rails on 18 Summit Avenue between Everett Avenue and Twenty-third Street, between 19 street intersections with the same kind of paving as provided by 20 Ordinance i 130 of the City of Iverett and passed ,Tune,18,1894, and 21 acaaapild acceptance filed with the city clerk on July,11,1894, and 22 the company to pay for said paving. 23 24 Section 4: This Ordinance shall be void unless the 25 Company within thirty days (30) after its passage shall file its 26 written acceptance with the City Clerk of the City of Everett, 27 subject to the terms and conditions set forth in this Ordinance. 28 29 Section 5 : This Ordinance shall take affect upon 30 31 .3.
