1 tuting the offense, or aids or abets the same, and whether <br /> 2 present or absent ; and every person who directly or indirectly <br /> 3 counsels, encourages, hires, commands, induces or otherwise <br /> 4 procures another to commit such misdemeanor, is and shall be <br /> 5 a principal under the terms of this ordinance and shall be <br /> 6 proceeded against and prosecuted as such. <br /> 7 <br /> Section 4 : If any part, provisions or section of this <br /> 8 <br /> ordinance shall be held to be void or unconstitutional, all <br /> 9 <br /> other parts, provisions and sections of the ordinance not <br /> 10 <br /> expressly so held to be void or unconstitutional, shall con- <br /> 11 <br /> tinue in full force and effect. <br /> 12 <br /> 13 Section 5 : Every person in charge or control of any <br /> 14 tenement, apartment house, inn, hotel , store, office building <br /> 15 or lodging house, who undertakes to furnish artificial heat <br /> 16 to another within such place, shall for such purpose install <br /> 17 and maintain a good and sufficient system which will uniform- <br /> 18 ally heat, and be capable of so heating, all parts there of <br /> 19 to a temperature of seventy (70) degrees, Fahrenheit in zero <br /> 20 weather, with due regard to all laws and ordinances pertaining <br /> 21 to and regulating ventilation and humidity, and it shall be <br /> 22 unlawful for such person to fail, neglect or refuse to install <br /> 23 or maintain the same. <br /> 24 <br /> Section 6: Every person in charge or control of the <br /> 25 <br /> artificial heating of any tenement, apartment house, inn, <br /> 26 <br /> hotel , store, office building or lodging house, in case arti- <br /> 27 <br /> ficial heating is done for or on behalf of another therein, <br /> 28 <br /> and every person who undertakes to furnish artificial heat <br /> 29 <br /> to another within such place, shall at all times ( except <br /> 30 <br /> during the months of June, July, A ugust and S eptember ) <br /> 31 <br /> between the hours of nine (9) o+ clock a.m. and ten (10)otclockp .m. <br /> -2- <br />
