owners interested, for and aginst said improvement, the Council has 1 determined that an emergency exists in that the sanitary conditions 2 in said District are a menace to the health, safety and welfare of 3 the Public to such an extent as to constitute a nuisance, now there- 4 fore 5 THE CITY OP EVERETT DOES ORDAIN: 6 7 Section 1 : That the alley East of Broadway from the manhole on 8 the north property line of 38th St . to the center line of 39th St . ; 9 thence westerly along the center line of 39th St . to a point 21 feet 10 west of the east property line of Broadway; thence southerly 21 feet 11 from and parallel to the east line of Broadway to the center line of 12 40th St . ; thence easterly along the center line of 40th St . to the 13 center line of the alley east of Broadway; thence southerly along thl 14 center line of the alley east of Broadway to a point on the north 15 property line of Cascade View; also in the alley east of Broadway 16 from the center line of 40th. St. northerly 90 feet , be improved by 17 the complete construction of a sewer together with all necessary 18 appurtenances thereto , and such other work as is necessary to make a 19 complete improvement according to plans and specifications prepared 20 under the direction of the City Engineer, which plans and specifi- 21 cations are hereby adopted and approved. 22 Section 2: that the cost and expense of such improvement, in- 23 eluding all necessary and incidental expenses, shall b`e borne by and 24 assessed against the property included in the assessment district 25 herein created in accordance with law. The City of Everett shall not 26 be liable in any manner for any portion of the costs and expenses of 27 such improvement. 28 29 Section 3 : there is hereby established a Local Improvement 30 District to be called Local Improvement District No . "" 40166 359 . 31 which District shall include the following described property: -2-
