Pay Equity <br /> <br />The Agency agrees to ensure that “similarly employed” individuals in its <br />workforce are compensated as equals, consistent with the following: <br /> <br />1. Employees are “similarly employed” if the individuals work for the same <br />employer, the performance of the job requires comparable skill, effort, and <br />responsibility, and the jobs are performed under similar working conditions. <br />Job titles alone are not determinative of whether employees are similarly <br />employed; <br /> <br />2. The Agency may allow differentials in compensation for its workers if the <br />differentials are based in good faith and on any of the following: <br /> <br />a. A seniority system; a merit system; a system that measures earnings by <br />quantity or quality of production; a bona fide job-related factor or factors; <br />or a bona fide regional difference in compensation levels. <br /> <br />b. A bona fide job-related factor or factors may include, but not be limited <br />to, education, training, or experience that is: Consistent with business <br />necessity; not based on or derived from a gender-based differential; and <br />accounts for the entire differential. <br /> <br />c. A bona fide regional difference in compensation level must be: <br />Consistent with business necessity; not based on or derived from a <br />gender-based differential; and account for the entire differential. <br /> <br />This contract may be terminated by the County, if the County, the Washington <br />State Department of Enterprise Services, or the Washington State Department <br />of Commerce determines that the Agency is not in compliance with this <br />provision. <br /> <br />XI. PROJECT MANAGEMENT <br /> <br />A. Lead-Based Paint <br /> <br />The Agency must comply with the Lead-Based Paint Poisoning Prevention Act <br />(42 U.S.C. §§ 4821-4846), the Residential Lead-Based Paint Hazard <br />Reduction Act of 1992 (42 U.S.C. §§ 4851-4856), and implementing regulations <br />at 24 CFR part 35, subparts A, B, M, and R, which apply to activities under this <br />Contract. <br /> <br />B.
