A-Purpose—General. <br /> It is the purpose of this section to authorize the alternate design and construction of mixed-use <br /> apartment buildings exclusively within the residential targeted area of downtown as defined in <br /> Ordinance No. 2347-98 (as amended). Based upon recommendations of technical professionals, <br /> pursuant to Section 104.2.8 of the 1997 Edition of the Uniform Building Code as adopted as part <br /> of the Everett Building Code (Chapter 16.01 EMC), the Building Official approves as an <br /> alternate design and method of construction mixed-use apartment buildings within downtown's <br /> residential targeted area designed and constructed pursuant to this section based upon the <br /> following findings: (1) the proposed design is satisfactory and complies with the provisions of <br /> the Uniform Building Code and the material, method and work offered is, for the purpose <br /> intended, at least the equivalent of that prescribed in the Uniform Building Code in suitability, <br /> strength, effectiveness, fire resistance, durability, safety and sanitation; and (2) sufficient <br /> evidence or proof has been submitted to substantiate the alternate design and construction. <br /> The provisions of this section may be used to design and construct mixed-use apartment <br /> buildings within the residential targeted area as described in Ordinance No. 2347-98 (as <br /> amended). Buildings designed and constructed under this section shall comply with all <br /> provisions of the Everett Building Code, the Uniform Building Code as adopted as part of the <br /> Everett Building Code and of this section. Where a provision in this section is in conflict with <br /> the Everett Building Code or the Uniform Building Code, the provisions of this section shall take <br /> precedence. <br /> B-Construction. <br /> Six story buildings complying with this section may be designed and constructed where the <br /> basement and/or first story are of Type I construction with a maximum of five stories of Type V <br /> construction over the Type I story. The lowest Type V story shall be of Type V 2-hour <br /> construction and the upper four stories constructed of Type V 1-hour construction. The Type I <br /> construction shall be separated from the Type V 2 hour construction above with a three-hour <br /> occupancy separation. The Type V 2-hour construction shall be separated from the Type V 1- <br /> hour construction by a two-hour fire resistive assembly. <br /> Construction Types. Type I and Type V 1-hour shall be as specified in the Uniform Building <br /> Code. Type V 1-hour construction with two-hour fire resistive assemblies of load bearing walls <br /> will comprise the Type V 2-hour story. <br /> C-Occupancy. <br /> The occupancy of the top five stories of buildings designed and constructed pursuant to this <br /> section shall be limited to Group R, Division 1 apartment occupancies. Occupancies located on <br /> other stories shall be limited to: <br /> Group A, Division 3 and Group B drinking and dining establishments and assembly areas <br /> for common use of residents <br /> Group B - Offices <br /> 2 <br />
