<br />Fulton Street Pedestrian Bicycle Corridor PAGE 11 OF 114 CONTRACT <br />FEDERAL AID # TAP-0420(026) <br />WO #3785 September 6, 2024 <br /> <br />responsive Bid, and with a proposed recycled materials percentage that is exactly equal 1 <br />to the highest proposed recycled materials amount, are eligible to draw. 2 <br /> 3 <br />1-03.3 Execution of Contract 4 <br />(July 8, 2024 APWA GSP Option B) 5 <br /> 6 <br />This section is supplemented with the following: 7 <br />No later than 5 calendar days after the Award date (not including Saturdays, Sundays and 8 <br />Holidays), the successful Bidder shall provide DBE Trucking Credit Form(s) (WSDOT Form 9 <br />272-058) when trucking appears on the DBE Utilization Certificate (WSDOT Form 272 -10 <br />056). The DBE Trucking Credit Form shall document how the DBE Trucking firm will be 11 <br />able to perform the scope of work subcontracted to them. 12 <br /> 13 <br />Trucking forms will be returned for correction. Trucking Credit Form(s) will not be included 14 <br />as part of the executed Contract. 15 <br /> 16 <br />DBE Trucking Credit Forms shall be submitted in one of the following ways: 17 <br />1. By Mail to: 3200 Cedar Street Everett, WA 98201 19 <br /> 20 <br /> 21 <br /> 22 <br /> 23 <br />1-03.4.RTF 24 <br />1-03.4 Contract Bond 25 <br />(July 23, 2015 APWA GSP) 26 <br /> 27 <br />Delete the first paragraph and replace it with the following: 28 <br /> 29 <br />The successful bidder shall provide executed payment and performance bond(s) for the 30 <br />full contract amount. The bond may be a combined payment and performance bond; or 31 <br />be separate payment and performance bonds. In the case of separate payment and 32 <br />performance bonds, each shall be for the full contract amount. The bond(s) shall: 33 <br />1. Be on Contracting Agency-furnished form(s); 34 <br />2. Be signed by an approved surety (or sureties) that: 35 <br />a. Is registered with the Washington State Insurance Commissioner, and 36 <br />b. Appears on the current Authorized Insurance List in the State of Washington 37 <br />published by the Office of the Insurance Commissioner, 38 <br />3. Guarantee that the Contractor will perform and comply with all obligations, duties, 39 <br />and conditions under the Contract, including but not limited to the duty and obligation 40 <br />to indemnify, defend, and protect the Contracting Agency against all losses and 41 <br />claims related directly or indirectly from any failure: 42 <br />a. Of the Contractor (or any of the employees, subcontractors, or lower tier 43 <br />subcontractors of the Contractor) to faithfully perform and comply with all contract 44 <br />obligations, conditions, and duties, or 45 <br />b. Of the Contractor (or the subcontractors or lower tier subcontractors of the 46 <br />Contractor) to pay all laborers, mechanics, subcontractors, lower tier 47 <br />subcontractors, material person, or any other person who provides supplies or 48 <br />provisions for carrying out the work; 49
