<br />Fulton Street Pedestrian Bicycle Corridor PAGE 19 OF 114 CONTRACT <br />FEDERAL AID # TAP-0420(026) <br />WO #3785 September 6, 2024 <br /> <br />Payment for this item will be made on a prorated monthly basis for work completed in 1 <br />accordance with this section up to 75% of the lump sum bid. The final 25% of the lump 2 <br />sum item will be paid upon submittal and approval of the completed Record Drawings set 3 <br />prepared in conformance with these Special Provisions. 4 <br /> 5 <br />A minimum bid amount has been entered in the Bid Proposal for this item. The Contractor 6 <br />must bid at least that amount. 7 <br /> 8 <br />1-06.GR1 9 <br />Control of Material 10 <br /> 11 <br />1-06.INST1.GR1 12 <br />Section 1-06 is supplemented with the following: 13 <br /> 14 <br />1-06.OPT2.GR1 15 <br />Build America/Buy America 16 <br /> 17 <br />1-06.OPT2(A).GR1 18 <br />(December 20, 2023) 19 <br />General Requirements 20 <br />In accordance with Buy America Preferences for Infrastructure Projects requirements 21 <br />contained in 2 CFR 184 and Division G, Title IX - Build America, Buy America Act (BABA), 22 <br />of Public Law 117-58 (Infrastructure Investment and Jobs Act), the following materials 23 <br />must be American-made: 24 <br /> 25 <br />1. All steel and iron used in the project are produced in the United States. This 26 <br />means all manufacturing processes, from the initial melting stage through the 27 <br />application of coatings, occurred in the United States. 28 <br /> 29 <br />2. All manufactured products used in the project are produced in the United States. 30 <br />This means the manufactured product was manufactured in the United States, 31 <br />and the cost of the components of the manufactured product that are mined, 32 <br />produced, or manufactured in the United States is greater than 55 percent of the 33 <br />total cost of all components of the manufactured product, unless another 34 <br />standard for determining the minimum amount of domestic content of the 35 <br />manufactured product has been established under applicable law or regulation. 36 <br /> 37 <br />3. All construction materials are manufactured in the United States. This means 38 <br />that all manufacturing processes for the construction material occurred in the 39 <br />United States. 40 <br /> 41 <br />An article, material, or supply will be classified in one of three categories: 1) Steel and 42 <br />Iron, 2) Manufactured Product or 3) Construction Material. Only a single category will 43 <br />apply to an item and be subject to the requirements of the BABA requirements of that 44 <br />category. Some contract items are composed of multiple parts that may fall into different 45 <br />categories. Individual components will be categorized as a construction material, 46 <br />manufactured product, or steel and iron based on their composition when they arrive at 47 <br />the staging area or work site. When steel or iron are a component of a manufactured 48 <br />product or construction material, the steel and iron components will be subject to “Steel 49 <br />and Iron Requirements” of this Specification. 50 <br /> 51
